ORDER Granting Plaintiffs’ Motion for Judgment against Defendant Transamerica Life Insurance Company. IT IS FURTHER ORDERED that the Clerk of Court shall enter Judgment in the amount of $190,644.19 in favor of Defendant Kimtran Rizzolo for the use of Plaintiffs Kirk Henry and Amy Henry against Garnishee Defendant Transamerica Life Insurance Company. Signed by Judge Philip M. Pro on 12/4/2012. (Copies have been distributed pursuant to the NEF - SLD)
For the past several months, racketeer Rick Rizzolo’s step mother Kimtran has been threatening litigation against the life insurance company that holds one of her ill-gotten annuities in the event they release the funds to beating victim Kirk Henry.
Transamerica Life Insurance has filed several Motions in U.S. Federal Court stating that they will release the funds to Henry only on the condition that the Court order them to do so, and release them from any claims Kimtran may file against them for not protecting her funds.
Yesterday, Judge Pro issued such an Order. This Order is in lieu of Kimtran’s pending Appeal to the Ninth Circuit Court pleading that she is entitled to keep all of the money her late husband Bart Rizzolo placed in her annuities derived from the secret sale of the Philadelphia Crazy Horse Too.
In the event Kimtran prevails on Appeal, the $190, 644.19 must be returned to her, but the probability of her succeeding is extremely doubtful. - SM
