The ruling on whether Movement for Democratic Change (MDC) treasurer general, Roy Bennett should be acquitted or not has been set over to March 31st by High Court Judge, Justice Chinembiri Bhunu.

The move by the judge came after Bennett's defense counsel had made an application to have the top MDC man acquitted at the close of the prosecution's case. But chief prosecutor, Attorney General, Johannes Tomana, Wednesday opposed acquittal prompting Justice Bhunu to reserve his judgment to the end of this month. Lead defense counsel,Beatrice Mtetwa, earlier on argued that the State has no evidence that proves the MDC deputy agriculture minister designate was in possession of firearms linked to the terrorism charges. Bennett is charged together with key state witness, Peter Hitshmann of possessing arms of war to commit acts of sabotage and terrorism. The MDC official however refutes the allegations, with his party on record, saying the charges are a "mere political ploy" to fix one of their officials. It is the state's allegation that Bennett communicated with Hitshmann using e-mails in the purported acts of banditry but the defense counsel has dismissed the e-mails as unauthentic. If the judge rules in favour of the defense team on the 31st of March, it would mean Bennett's acquittal, that is if the state does not appeal. But if he rules in favour of the state, the case will continue.
