Tyranny Under Color of Law



It's chilling to see American citizens forced to wear masks.  Too reminiscent of Nazi Germany when over a half million people had to wear a badge to identify as a Jew.    "Jews over the age of six in Germany are required to wear a yellow, six-pointed star with the word "Jude" (German for "Jew") across the front in black, sewn to their outer clothing at all times."    If we can be ‘ordered' to wear a mask why not a badge, a wristband, a chip
But these these governors are just trying to protect their citizens. They're not dictators.   No?   Kim Jong-Il - "There's such total control that four people talking together can be seen as a conspiracy."
  • Governors who ordered state-wide lockdowns placed every single citizen under house arrest.  They've issued restrictions on how close we can to stand to each other, how many can stand together.
Fidel Castro -  "[Cuba's] "new government nationalized all businesses, including the hotels."   
  • Governors in 45 states used their pen and phone to nationalize American companies.  These governors expropriated every single company, business, and shop in their state.
Adolf Hitler - "Perhaps the most important factor in Hitler's rise to power was his passing of the Enabling Act in 1933 which allowed him to make laws without approval by anyone else. . . Hitler could make any rules without opposition."

  • Our governors don't need an Enabling Act to establish their dictatorship.  Their police powers are sufficient to establish police states.  They already can and do "make any rules without opposition".
Governors are using the virus as subterfuge to take control of the American people.  They report the elderly, our most vulnerable, as most likely to die from the virus.  But the elderly being more at risk from a virus is hardly new.   In fact, California's 2017/2018 flu season was so brutal they didn't even count ‘our most vulnerable'.   California's Department of Public Health says the flu killed 329 people under age 65 in the last flu season, from October 2017 to August 2018.  But that is likely only a small fraction of the total deaths in the nation's most populous state because the department didn't count the hundreds of deaths of people 65 and older. The state figure could account for just 1 in 10 flu death.   Governors claim their states lack resources to handle out-of-control contagion.  Governor Newsom shuts down California based solely on projections.  He cites a ‘model' that California would have 25 million Coronavirus infections.   Yet at the time there were just 1,030 confirmed cases and 18 deaths in California.  Hardly an epidemic to cripple his state.  So with zero evidence of any on-the-ground crisis or imminent disaster, this governor takes control of every person in his state (40 million people) every business, every church, every public park and beach.

And the idea that a wildly contagious virus can't be managed is another lie. California, already faced and survived an overwhelming epidemic in the 2017 flu season, far worse than the current Wuhan virus.  
"According to the Los Angeles Times, hospitals are so overwhelmed by the influx of flu patients that they have been forced to fly in nurses from out of state and are turning away ambulances. Some have set up tents in parking lots to triage the inordinate numbers of flu patients coming for care, while scheduled, voluntary surgeries are being postponed to free up resources."  
Still, the lies persist and other states quickly jump on the takeover bandwagon.  But why are there no restraints, no requirements for the governor to show just cause for his/her order?  Why are schools closed across the state though children are not seriously affected by this virus?  These questions are never asked because the governors issue these orders under color of law, and Americans are law-abiding people.   However, an unconstitutional order issued under color of law is in itself an abuse of power.  

TITLE 18, U.S.C., SECTION 242

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both.  
Tyranny does best when introduced by law.  In 2019, millions of Hong Kong citizens launched protests against a law that would allow the extradition of suspects to mainland China.  The protests continued for months.  They didn't accept a law as their master, they didn't silently acquiesce.   During the protests, pro-democracy supporters began waving American flags, singing the US National Anthem to show their "desire for American-style freedoms".    But those American-style freedoms were pre-virus, pre-lockdown. Perhaps today it would be more appropriate for Americans to wave Hong Kong flags to remind us of that time when we were the ‘beacon of freedom'.

Why are we waiting for these governors to set us free?  We were set free over two hundred years ago.  Patriots fought a bloody war to establish individual liberty, sacrificed their wealth, their security, their lives.  They fought and they won Declaration of Independence - In Congress, July 4, 1776

No governor, senator, president, or judge has the right to strip us of our Constitutional rights. .  No government has the authority to rule us, to tell us where to stand, what to wear, how to operate our business.  No law has the authority to deny us individual libertyAmendment I
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances
This clause is to protect our rights from government, not just Congress.  People will argue the orders aren't permanent.  Maybe not but they're a precedent.  If governors are allowed to lockdown every citizen and seize all businesses on the basis of predictions, then any model right or wrong will serve as justification.  If they're allowed to go to the most radical actions possible as a first response, then America will be shut down again and again.   We don't need to be grateful when governors release us from bondage.  We need to address what happened, how it happened, and we need to make sure it never happens again.  Next time there may be no reopening.
