Kimtran Rizzolo’s bogus argument to stall payment to Kirk Henry

Convicted racketeer Rick Rizzolo's stepmother Kimtran Rizzolo argues that beating victim Kirk Henry should be responsible for her payment of $100,000 to the law firm of Patti & Sgro to represent her stepson; her legal fees paid to her personal attorney Herb Sachs; and approximately $80,000 she paid to attorney John Dawson to stash Rick and Lisa Rizzolo's ill-gotten assets in the Cook Islands.
Kimtran also argues that there was an undetermined sum of money owed to Rick Rizzolo by her late husband Bart Rizzolo, but she has no proof. In response to her claim, Senior United States Judge Philip Pro ruled on April 19: "Although Rick Rizzolo argues his deposition testimony shows only a desire to pay an antecedent debt, not an intent to defraud, Rick Rizzolo presents (1) no evidence Bart Rizzolo actually made any such loans to Rick Rizzolo, (2) no evidence regarding the amount of any such loans such that a reasonable jury could conclude Rick Rizzolo received reasonably equivalent value for the transfers made to Bart Rizzolo, and (3) no evidence that any such loan was a valid and existing debt."
