Did you hear about HB 1089, just signed by the Governor in Va?

But the drama gets worse !!
  • We WON in Circuit Court, with the judge agreeing that we had the right under the Zoning Ordinance to conduct our oyster farm
  • The County appealed to the Supreme Court and they reversed the Circuit Court's position, thereby siding with the County
  • Then HB 1089 passed the General Assembly (128 to 5) and was signed by there Governor last week. HB 1089 basically included aquaculture as agriculture in Va. The net affect means that wherever land is zoned in Va for agriculture, aquaculture can be conducted and Counties (like York County) cannot require a Special Use Permit.
  • So York County is now suing my wife and me (papers will be served on Monday) to shut down our farm and they are proposing widespread zoning changes throughout the County that would possible remove the existing right to conduct agriculture on over 6000 properties in York County.
These supervisors have lost their objectivity.... it's like living in Hazard County... Did you ever watch The Dukes of Hazard? Greg Garrett www.forbiddenoysters.com
