I'm not sure who racketeer Rick Rizzolo should fear the most right about now; United States Magistrate Judge George Foley, or jail house lawyer James Kimsey?
In an ORDER issued this afternoon, Judge Foley commands Kimsey,
alias Spud, to appear in Federal Court on January 29 to argue why he should not be held in criminal contempt for ghost writing dozens of frivolous motions designed to stall the resolution of unpaid beating victim Kirk Henry's lawsuit against Rick and Lisa Rizzolo.
Spud may have just been trying to do a fellow ex-con a favor, but it backfired big time!
According to the
Las Vegas SUN, Kimsey is associated with the Las Vegas chapter of the Hell's Angels, and Rick should know that pissing off a Hell's Angel is worse than pissing of a judge!

ORDER TO JAMES E. KIMSEY TO SHOW CAUSE WHY HE SHOULD NOT BE HELD IN CRIMINAL CONTEMPT
Based on the information provided to the Court in support of Plaintiffs’ Motion to Reveal Pro Se Litigant Rick Rizzolo’s Ghost Writer; Request for Verification Pursuant to FRCP 11; Alternatively For Contempt Sanctions (#184) and Defendant Rick Rizzolo’s response thereto, it appears that Mr. Kimsey’s actions as a non-attorney in preparing and filing legal instruments constitutes the unauthorized practice of law on behalf of Defendant Rick Rizzolo.
ORDER TO SHOW CAUSE
It appearing from the records and files in this case that James E. Kimsey has engaged in the unlawful practice of law in the above entitled action; therefore, IT IS ORDERED that James E. Kimsey appear before the Honorable Philip M. Pro, United States District Judge at 333 Las Vegas Blvd. South, Las Vegas, Nevada 89101, on Friday, January 29, 2010, at 9:30 a.m., in Courtroom 7C or as soon as counsel can be heard, to show cause, if any, why he should not be found guilty of and punished for contempt of court for the unlawful practice of law in the above entitled action.
IT IS FURTHER ORDERED that the Clerk of Court shall serve a copy of this Order
upon the Office of the United States Attorney.
IT IS FURTHER ORDERED that the United States Marshal shall serve this Order to
Show Cause on James E. Kimsey.

But that's not all that's bothering Judge Foley. In an OPPOSITION also filed this afternoon, Rizzolo's new attorney accuses Judge Foley of filing a "Defective" ruling ordering Rizzolo to pay Henry's attorneys $11,240 in legal fees for having to answer Spud's numerous court filings.
In addition to referring to Judge Foley's ruling as "Defective," Rizzolo's latest attorney, Kenneth G. Frizzel, III, a.k.a. "
The Ticket Fixer," accuses the judge of acting in "Bad faith."
Not a nice thing for "The Ticket Fixer" to say about a judge who's family name appears on the front of the
Foley Federal Building, 300 Las Vegas Boulevard South!

While this nonsense is going on, Mr. Henry and his family are celebrating their ninth Christmas since his neck was broken by one of the Rizzolo's managers after Henry objected to a padded bar bill at the now-defunct Crazy Horse Too topless bar. To date, Henry has not received one cent from the Rizzolo's for his injuries.
