U.S. Military at 82-Year Recruiting Low

WASHINGTON, D.C. – Amid growing national security threats and questionable U.S. military readiness, senior Pentagon officials testified before Congress last week that the military services fell short of their 2023 recruiting goals by 41,000 recruits. The military needs about 160,000 people a year to join to sustain its authorized strength, and this 25 percent shortfall marks the worst recruiting performance since the U.S. military became an all-volunteer force in 1973.

Sandra Merritt Continues Challenge in Criminal Case

SAN FRANCISCO, CA – Superior Court of San Francisco County Judge Harry Jacobs denied Sandra Merritt’s motion to dismiss the remaining criminal counts brought against her by former California Attorney General Xavier Becerra for her undercover journalism work which exposed Planned Parenthood’s trade in baby body parts. Liberty Counsel will appeal this decision on behalf of Merritt and continue to pursue the dismissal of all eight felony charges (originally 15) against her on the grounds that California’s recording law, Penal Code section 632(a), is a content-based speech restriction that violates the First Amendment to the U.S. Constitution.

VA Supreme Court Sides With Teacher on Refusing Pronoun Policy

The Virginia Supreme Court ruled yesterday to reinstate a lawsuit that alleges a high school teacher’s free speech and free exercise of religion rights were violated when he was fired for declining to refer to one his female student by male pronouns. The ruling reverses a circuit court’s decision to dismiss the case before evidence was heard and mandates it move forward to trial back in the circuit court.

AZ Supreme Court Hears Oral Arguments on Near-Total Abortion Ban


PHOENIX, AZ – The Arizona Supreme Court heard oral arguments yesterday in Planned Parenthood Arizona v. Mayes about whether to restore Arizona’s pre-statehood near-total abortion ban from 1864 or solely enforce the 15-week ban enacted in March 2022 that is currently in effect.

Congress Should Oppose NDAA that Funds Politicized Military


WASHINGTON, D.C. – The U.S. Congress should vote against provisions in the National Defense Authorization Act (NDAA) that fund abortion travel, gender “transition” surgeries, and other provisions that do not advance military readiness.

Medical Mutilation Is Not the Answer to Gender Confusion


A new study published in Europe shows that medically mutilating surgeries do not relieve gender confusion or other underlying mental health issues. In fact, the study revealed patients with gender confusion who received hormone treatments or mutilating gender surgeries showed a greater increase in specialized “psychiatric treatment” than those with gender confusion who did not undergo those procedures. The authors recommended a “cautious assessment” of gender surgeries since they are not likely to resolve the mental health issues of people in “gender distress.”

Talk Therapy Bans Will Be Struck Down


WASHINGTON, D.C. – Today, the U.S. Supreme Court declined to review the case of a licensed marriage and family therapist who sought to strike down Washington state’s ban that prevents counselors from providing minor clients with help to reduce or eliminate unwanted same-sex attractions, behaviors, or gender confusion. Justices Thomas, Alito, and Kavanaugh would have voted to take the case because of the current conflict in the federal Courts of Appeal as a result of Liberty Counsel’s cases, Otto v. City of Boca Raton and Vazzo v. City of Tampa, both of which struck down nearly identical counseling bans that the Ninth Circuit Court of Appeals upheld in Tingley v. Ferguson.

U.S. Supreme Court Frees Christmas From the “Lemon Test”


ORLANDO, FL – The return of the Christmas season prompts a return of the annual scrutiny of Christmas expressions in the public square. For years, opponents to religious expression and activist courts have fought using the U.S. Supreme Court created “Lemon Test” to remove the Ten Commandments, crosses, Nativity scenes, and other religious symbols and displays from public property. However, the “Lemon Test” had been inconsistently applied through the years and the High Court recently abandoned it in favor of the original and historical textual meanings of the Constitution. MI Schools’ Racial Christmas Directives Are Unconstitutional


HOLT, MI – Liberty Counsel sent a demand letter to Superintendent David Hornak of Holt Public Schools in Michigan regarding the unconstitutional bans on Christmas holiday symbols, decorations, and expression contained in a so-called “Racial Guide” sent to teachers in 2021, 2022, and any that will be published this year. As a result of multiple complaints from teachers, Liberty Counsel has demanded the school district retract the “Decentering Christmas”/“Holiday Celebrations”/“Racial Justice Guide” email published December 3, 2021, “Winter Celebrations Communications FAQ” published December 2, 2022, and any similar unconstitutional bans and directives promulgated in 2023.

Desperate Army Backpedals on Soldiers Booted Over COVID

Deceptive Abortion Initiative Violates Florida Law

TALLAHASSEE, FL – Liberty Counsel has filed a reply brief on behalf of Florida Voters Against Extremism (FLVAE) urging the Florida Supreme Court to not approve the wording of a proposed amendment that would codify unrestricted abortion as a right in the state’s Constitution. In the reply brief, Liberty Counsel argues that the initiative is misleading and deceptive and violates the single subject rule. In the brief, Liberty Counsel states the sponsor completely sidesteps these legal issues and fails to provide a meaningful rebuttal.

Wauwatosa Issues Absurd and Unlawful Email To Censor Christmas

WAUWATOSA, WI – Liberty Counsel sent a demand letter to the City of Wauwatosa, Wisconsin, regarding its unconstitutional ban on Christmas holiday symbols, decorations, and expressions within public buildings and by its employees. City officials directed employees in an email to create an “inclusive” environment for all by refraining “from using religious decorations” that are “solely associated with Christmas,” such as red and green colors, when decorating public spaces in city buildings. Liberty Counsel demands the immediate retraction of the ban.
