A federal judge in Washington ruled Tuesday that the government was properly holding two Guantánamo detainees as enemy combatants, the first clear-cut victories for the Bush administration in what are expected to be more than 200 similar cases. That case had been the only one to reach a full court hearing after a landmark ruling by the Supreme Court in June that said Guantánamo detainees have a constitutional right to challenge their detention in habeas corpus cases.
Despite the ruling, whomever becomes the caretaker of these individuals will be in a quandary. Release them because the liberal left believes they were victims of Bush and Cheney's overreaching and ethnic profiling, or risk putting pissed off, genuine terrorists back on the streets. Let's see if Barack Obama breaks another campaign promise and backs off his closing of Gitmo, now that he's privy to post-election intel.
