Could the Equality Act influence this SCOTUS sessionAs usual, this commentary could be pushing the envelope on assumption. Should that be the case, it's certain that someone will call out the defects following. A case that is now being considered by the Supreme Court of the United States was the subject of a recent column--Sex discrimination doesn't translate to pantsuit equality. Bringing it back into focus is the Equality Act, H.R. 5, that the House of Representatives is poised to vote on this week.

The question now before SCOTUS regarding the RGGR Harris Funeral Homes, Inc. v. Equal Employment Opportunity Commission has to do with the classification of transgenderism regarding the Civil Rights act of 1964 and the definition of "sex discrimination." With the Equality Act ready to redefine the sexes to include a plethora of emotional "genders," the scope of protected classes could become limitless, forcing citizens to abandon their own rights to cater to a privileged few. The whole promulgation of civil rights has had a detrimental effect on this nation by creating special classes of citizens that undermines the purpose of our founding documents to their core. When the Declaration of Independence proclaimed that "all men are created equal" it did not discriminate between skin color or sex. The term "men" was the inclusive for mankind, which means male and female. In that the founders believed the truth of the Holy Bible it also means that there is only one form of mankind having descended from one set of parents. A fact, by the way, which has been proven scientifically as all DNA has been traced back to an original man and woman. Look it up. "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness." Clearly, every individual was recognized to have access to these rights, so why has government been enacting extra rights to every identity group that crops up? Constitutionally, every individual already has equal rights. These privileges being handed out by government to special interest factions amounts to preferred treatment and guts the Constitution. They are redundant.

Some may refer back to the Dred Scott case of 1857 to claim that the Constitution did support racism due to the Supreme Court ruling that slaves were not citizens. Here's a point that is regularly overlooked--SCOTUS is not the final arbiter of legislation, it interprets legislation but cannot legislate despite democrats believing otherwise. Because its rulings may be overturned by the action of the two other branches of government, as occurred in the passing of the 13th Amendment (we won't go into the convenient ignoring of the original 13th Amendment that simply disappeared for over a century), the Emancipation Proclamation. Now the democrat-led House is attempting to change the meaning of natural language and, in so doing, change how the Constitution protects individual liberty by creating special "rights" for newly created victim populations. It weakens the republic by dividing Americans into special pockets of privileged victims. According to our founding documents there is no such thing as classes of individuals, for all men are created equal. What part of all does the Left not understand? Another side of this question is, should the Equality Act pass both chambers of Congress and be signed by the president (fat chance), would it have any standing to be considered by the justices of the Supreme Court as they render the Harris Funeral Homes case? As stated in a previous column (linked above), SCOTUS should bypass the whole question of transgenderism in regard to the dismissal of the employee by the funeral home. This was a matter of breach of contract, no more, no less. In the end, the Equality Act equalizes nothing. It does, however, polarize everyone and give government the power to strip individuals of their livelihood under the guise of fairness--a leftist euphemism for theft if there ever was one. It could be credibly argued that sanctioned robbery has been the purpose all along.
