Calgary, AB: The Canadian Taxpayers Federation celebrated today’s Alberta Court of Appeal decision that found the federal carbon tax unconstitutional. “This is a big win for taxpayers in Alberta and across Canada,” said Franco Terrazzano, Alberta Director for the CTF. “The carbon tax is all economic pain without the environmental gain and it’s great to see Alberta’s courts ruling against Ottawa’s heavy-handed and unconstitutional carbon tax.”
The court ruled 4-1 that Ottawa’s carbon tax is unconstitutional, finding that the Greenhouse Gas Pollution Pricing Act intrudes on provincial jurisdiction. The CTF was the only non-government third-party opposing the carbon tax at the Alberta Court of Appeal. The CTF also presented arguments regarding carbon taxes in the Ontario and Saskatchewan courts and is the only non-government third-party opposing the carbon tax at the Supreme Court of Canada. “Premier Jason Kenney deserves credit for giving taxpayers the chance to defeat Ottawa’s carbon tax in Alberta’s courts,” said Terrazzano. “Today’s decision gives taxpayers a lot of optimism heading into the Supreme Court challenge next month.”
