SAF, CalGuns and Partners asking Injunction against 'Age-Based Gun Ban'

BELLEVUE, WA – The Second Amendment Foundation and Calguns Foundation are seeking an injunction against a section of California’s penal code that prohibits young adults, ages 18-20 from purchasing or acquiring firearms, and they are asking the federal court to declare this prohibition to be unconstitutional. Joining SAF and Calguns are the Firearms Policy Coalition, Firearms Policy Foundation, a local business and three private citizens. The lawsuit was filed in U.S. District Court for the Southern District of California. The plaintiffs are represented by lead counsel John W. Dillon of Carlsbad, California-based Gatzke Dillon & Balance LLP. A copy of the court filing can be accessed at Fiirearmspolicy.

FED. JUDGE DENIES DOJ MOTION TO DISMISS SAF CALIFORNIA REGISTRATION CASE

BELLEVUE, WA – A federal judge has denied a motion to dismiss a lawsuit against the California Department of Justice and Attorney General Xavier Becerra over the state’s failure and refusal to establish a properly functioning internet-based firearms registration system that was mandated by law. U.S. District Judge Morrison England, Jr., a George Bush appointee, denied the motion, noting in his 10-page ruling that, “the Supreme Court specifically recognized that a violation of procedural due process occurs when ‘it is the state system itself that destroys a complainant’s property interest, by operation of law,’ whether the state’s action “is taken through negligence, maliciousness or otherwise.”

SAF, ISRA WIN AS ILLINOIS APPEALS COURT DISMISSES DEERFIELD APPEAL

BELLEVUE, WA – The Second Amendment Foundation has posted yet another victory in Illinois, as the Second District Appellate Court has dismissed an attempt by the Village of Deerfield to challenge a permanent injunction against the community’s ban on so-called “assault weapons” and “large-capacity magazines.”

FED. JUDGE PERMANENTLY ENJOINS RIVERSIDE COUNTY’S CCW APPLICATION DENIALS

BELLEVUE, WA – A senior U.S. District Court judge in California has issued a permanent injunction against the Riverside County Sheriff’s Department’s longstanding policy of “dissuading, discouraging, and preventing non-United States citizens from applying for a CCW license,” in a lawsuit brought by the Second Amendment Foundation, Calguns Foundation and Firearms Policy Coalition. SAF, Calguns and FPC were joined by the Firearms Policy Foundation and Madison Society Foundation, and Arie Van Nieuwenhuyzen, a permanent resident alien who has lived in Riverside since 1983 and is a business owner there.

Portuguese Gun Rights Group Joins Growing International Coalition Against Gun Control

The International Association for the Protection of Civilian Arms Rights (IAPCAR) announced today that Portuguse gun rights group Associação Nacional da Arma de Portugal (ANARMA) have joined the international coalition of 33 associations in 23 countries dedicated to defending civilian firearms rights. ANARMA’s membership in the civilian arms rights coalition expands the European membership to twelve groups from ten different EU and non-EU countries.

SAF Court Victory Ends Gun Ban

A federal judge has issued a permanent injunction against the East St. Louis Housing Authority’s (ESLHA) ban on firearms possession by residents of government-subsidized public housing and thus granting a victory to the Second Amendment Foundation, which sued the town in 2018 over the ban.

‘RED FLAG’ LAWS MUST PROTECT DUE PROCESS, SAF INSISTS

BELLEVUE, WA – Extreme Risk Protection Orders, generically known as “red flag laws” that allow the seizure of private firearms based on a complaint filed with the authorities must include and guarantee due process, or they shouldn’t be allowed, the Second Amendment Foundation said today. Amid rising concerns about due process in the enforcement of such laws, which have already resulted in one fatal shooting in Maryland, SAF founder and Executive Vice President Alan M. Gottlieb said there is always the potential for abuse without careful scrutiny. He questioned the motives of some politicians who support “red flag” laws without consideration for the rights of affected gun owners.

Fed. Judge Denies Motion by Washington A.G. to Compel SAF Discovery in 3D Case

BELLEVUE, WA – A U.S. District Court judge in Seattle has denied a motion by the Washington State Attorney General’s office that sought to compel the Second Amendment Foundation and Defense Distributed to provide discovery responses in a lawsuit the state filed against the U.S. State Department relating to the publication of information about 3D printing of gun designs.

SAF VICTORY: IL. JUDGE ISSUES PERMANENT INJUNCTION AGAINST DEERFIELD GUN BAN

BELLEVUE, WA – An Illinois judge has issued a permanent injunction against the Village of Deerfield, Illinois prohibiting that jurisdiction from banning so-called “assault weapons” and thus granting a victory to the Second Amendment Foundation, which sued the town in 2018 over the ban. SAF was joined by the Illinois State Rifle Association and Deerfield resident Daniel Easterday, a lawful firearms owner. They were represented by Glen Ellyn attorney David Sigale.

SAF Files Federal Lawsuit Challenging Second Amendment Enforcement Practices

BELLEVUE, WA — The Second Amendment Foundation today filed suit in federal district court seeking to have federal and state laws preventing persons who, at one time in their lives, were subject to a mental health “hold” on the exercise of their Second Amendment rights overturned on the grounds that the way those laws and regulations are enforced are in violation of the Constitution.

SAF, CCRKBA SEEK NATIONAL DIALOGUE ON POLICE, CCW AFTER ALABAMA TRAGEDY

Mr. Bradford, 21, pulled out his gun to protect shoppers at an Alabama mall, his family said.BELLEVUE, WA – In the wake of last week’s tragic mistaken identity fatal shooting of an armed citizen in an Alabama shopping mall, the Second Amendment Foundation and Citizens Committee for the Right to Keep and Bear Arms are calling for a national dialogue on how police respond to “active shooter” reports in public venues, such as malls, restaurants or movie theaters. Officers responding to a shooting at the Riverchase Balleria Mall in suburban Hoover apparently mistook Emantic F. Bradford, Jr., 21, as the suspected shooter. Mr. Bradford had a carry permit according to his family but investigators have declined to confirm that. He had drawn his pistol and was fatally shot. “There are more than 17 million gun owners in the United States who are licensed to carry concealed,” noted SAF founder and Executive Vice President Alan M. Gottlieb. “In addition, there are untold numbers of legally-armed citizens in states where permits or licenses are not required for either concealed or open carry. In an active shooter incident, these citizens are well within their rights to act in self-defense or in defense of others, even when it means they draw a defensive sidearm but don’t immediately open fire.
