6th Amendment—Then and Now

As we have seen earlier in this series, times have changed. To a great extent this is due to the reality that honesty and integrity are, sadly, no longer highly valued character traits in America today. I fear the 6th Amendment has fallen victim to that reality.

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial,

When the 6th Amendment was ratified Iin 1787, there was no confusion about exactly what this clause meant. I have to view this clause from the standpoint of the people still confined in the Washington D.C. gulag as a result of the January 6, 2021, mostly peaceful demonstration. They have been bullied into plea bargains, and there have been few, if any, “speedy trials.”

by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law,

I have to reiterate the fact that the Founding Fathers were relying on honest, virtuous people with integrity for this and every one of the rights addressed in the Bill of Rights to function properly. In the case of the January 6, 2021 defendants, what do you suppose is the likelihood of these people having a public trial in the District of Columbia by an “impartial jury?” The citizens and government of the District of Columbia is overwhelmingly populated by people who support Joe Biden and are part of his corrupt Marxist government Deep State. Do you think any MAGA- oriented person could get a fair trial in that venue?

and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

In 1787, honest, virtuous, and moral people knew exactly what these clauses meant. It seems that in certain 2024 jurisdictions, these clauses mean nothing in certain high visibility legal actions, and some of the judges are pretending that this part of the United States Constitution doesn’t exist.

I believe the Founding Fathers would find modern day lawfare, as used by the Biden government, the State of New York, and the State of Georgia, to be reasons for a new revolution. Honest and moral people do not use the legal system and government resources against their political enemies. The Founding Fathers would likely be shocked to their very foundations at the blatant abuse of power demonstrated in New York, Washington D.C., Atlanta, and Miami against a former President and active presidential candidate as is being done to Donald Trump and even the January 6, 2021 defendants.

The 6th Amendment may be alive, but I’m not so sure how well it is.
