Tom Fitton: A cautionary word from a proven warrior against the deep state

Tom Fitton is not a politician, not a government employee, not an attorney.

He’s a veteran warrior against the deep state.

Fitton’s been President of Judicial Watch for the last 21 years.

Judicial Watch (JW) is a Washington, D.C.-based independent organization that primarily uses the Freedom of Information Act (FOIA) to seek access to government and other public records. And JW is aggressive at engaging in civil litigation to get the information it seeks.

If you’ve ever submitted a FOIA request—at any level of government—you know and appreciate the ordeal that can be involved in getting compliance from the source.

General, vaguely identified requests get nothing. The parameters of a request must be clearly defined. And even then, getting a response can, literally, take years and require significant financial expenditures to pay for photocopies of key documents.

While the FOIA law may have been well-intended, it’s use can be stifled by bureaucratic foot-dragging, at best, and flat obfuscation, at worse.

Such is the world of JW.

The organization is staffed by two-legged blood hounds, who have been successful in surfacing important information that is unsought, and therefore unreported, by the nearly non-existent cadre of investigative reporters in today’s print, televised, and internet media.


You won’t see Fitton interviewed much, if at all, on the legacy media where the on-air talking heads are not interested in what he has to say.  He is unlikely to support their crafted talking points. 

But Fitton is often invited to the FOX Business Channel, where he has appeared with Lou Dobbs. 

In 1980, Dobbs was an early hire at CNN where he became its chief economics correspondent, and hosted a business news program. He became a corporate executive for CNN, but left in 1997 after disputes with the network’s President.  

In a December 16, 2019 interview with Dobbs, Fitton said something that is a cautionary word to those expecting there to be serious consequences for the cadre of federal employees in the Department of State, the “Intelligence Community” (e.g., C.I.A., F.B.I.) and the Obama administration who designed, staffed, and conducted the soft coupe operation against Trump the POTUS candidate, then Trump the President.  

If you’re certain they will be held accountable, you best dispense with that certainty.  

What Fitton said comes at about the 2:47 mark in the interview posted on YouTube.  If you start at the beginning, it’s less than three minutes before you’ll hear the sober words from Fitton.  Most sobering for those who assume government bad-actors in the Russia Hoax will be held accountable.

We should not underestimate the self-defense mechanisms of the Swamp.

The immediate context of the Fitton comment is the alleged investigation being conducted on behalf of the Department of Justice by John Henry Durham, United States Attorney for the District of Connecticut. Durham has a stellar reputation—but then so did Robert Mueller and James Comey, once upon a time.


Dobbs spoke hopefully of a definitive outcome of the Durham investigation. Fitton responded with this:

“Well, I’m not seeing evidence, sorry to be the wet blanket, I’m not seeing any evidence of a criminal investigation {by Durham}. I suspect there’s going to be another report {on top of the IG Report}, but we all know what criminal investigations look like of a significant nature, and I’m not seeing any indicia.”

Indicia is the Latin plural of indicium, meaning distinguishing mark. In other words, Fitton sees no indications that a criminal investigation by Durham is underway. And Fitton is a man with many, and varied, sources of information.

That doesn’t mean Durham’s effort is moving toward a redux of the investigation former Attorney General Jeff Sessions assigned to U.S. Attorney John Huber to conduct last year into the Clintons. That investigation didn’t have to die; it never lived.

On the other hand, nor does it mean the Durham investigation is, as advertised, an intensively serious search for the truth.

All it means is that Tom Fitton knows much about how the Deep State operates. And if he’s not assuming an outcome where people are held accountable, then neither should we.
