The European Commission should avoid endorsing coordination on COVID-19 apps unless all factors have been analysed

Coronavirus apps must be scrutinised for consumer privacy

Brussels, BE – The European Data Protection Supervisor (EDPS) recommends an EU approach to COVID-19 mobile applications, in order to standardise the approaches of member states. The apps are intended to help track and inform citizens of those they meet who have tested positive for the novel coronavirus. The Consumer Choice Center’s Senior Policy Analyst Bill Wirtz cautions the European Union to take such an approach if questions of data privacy are still pending.
“The launch of several COVID-19 apps has presented serious questions regarding consumer privacy. EU Commissioner Thierry Breton says that it needs to be checked whether these apps are compatible with EU law. We would expect him to be certain of the answer before Berlaymont makes any decisions,” said Wirtz. “There is evidence suggesting that anonymised data can easily be re-identified. If member states are looking for anonymous data for statistical purposes, they will need to ensure they use the highest standard of security. If however tracking of individual movement is on the table, then that it is unlikely to be in line with existing privacy laws, even in a crisis. “Apps should also be built open-source so we can understand exactly which metadata they are due to collect. “A coordinated EU response on Corona-apps needs to be a structural comparison between already active apps and privacy rules. If this assessment is not done, the Commission is opening the floodgates to other infringements on the fundamental rights of EU citizens.
