New developments in Kirk Henry v. Lisa Rizzolo case



Late Friday, attorneys for beating victim Kirk Henry filed a MOTION TO COMPEL law firm Lionel Sawyer & Collins (LS&C) to produce financial records that may lead to the whereabouts of Rick and Lisa Rizzolo's hidden fortune.

Henry's neck was broken by an employee of the Rizzolos in 2001 rendering him a quadriplegic. To this day, the Rizzolos have refused to pay Henry one cent of a $10 million dollar judgement -- instead relying on their attorneys at LS&C and Patti & Sgro to find ways to hide their personal ill-gained assets. LS&C argues such records are protected by attorney client privilege, and say they will only produce such documents under Court Order. On December 29, 2008, Henry served Rizzolo's criminal defense law firm Patti & Sgro with a similar MOTION. Patti & Sgro made several unsuccessful efforts to squelch the MOTION, but United States Magistrate Judge George Foley on March 30, 2009 issued a Court Order stating that the firm must immediately produce the requested documents. Patti & Sgro then claimed that their law office suffered a flood, and all of the Rizzolo's financial and legal documents were destroyed! Henry's attorneys on Thursday of this week filed a Subpoena demanding Patti & Sgro produce documents proving their law office was flooded. Patti & Sgro filed an Objection to the Subpoenea, and Judge Philip Pro is expected to decide whether they must comply in the near future. In contrast to Patti & Sgro, Lionel Sawyer & Collins is a highly respected national law firm, and is certain to comply to a Court Order that is expected to be issued within the next several weeks.
