Judge Pro schedules penalty hearing for March 29 Temporarily lets convicted racketeer walk free

Parole officer: “Jail Rizzolo for 3 months, extend parole 3 years”



imageLAS VEGAS - During a highly charged two hour hearing Tuesday morning, convicted racketeer Rick Rizzolo's parole office Eric Christiansen, in a sealed report, asked U.S. Judge Philip Pro to incarcerate his parolee for a period of three months, and extend his parole for an additional three years. Judge Pro also heard similar requests from United States Attorney Eric Johnson, and Stan Hunterton, attorney for unpaid beating victim Kirk Henry. All motions from Rizzolo's attorney Dominic Gentile were denied including ones to squelch a Judgement Debtor Exam, force the Government to perform provisions of Rizzolo's plea agreement, and strike the modification of his parole.

Instead, Judge Pro ruled to proceed with a 12-C hearing based on the parole department's and U.S. Attorney's requests that Rizzolo's parole be revoked and that he be jailed. The hearing will occur on March 29, five days before Rizzolo's parole is set to expire. Rizzolo was free to leave the court. Hunterton pointed out that Rizzolo owned a $10,000 watch, but refused to abide by his plea bargain to pay over $25 million in court ordered debts while hiding his money overseas. imageHunterton also presented credit card receipts showing that Rizzolo was living a lavish lifestyle while not paying his obligations, and compared his treatment with that of ordinary parolees who would have had their parole revoked for infractions such much less than Rizzolo's. Hunterton pointed out Rizzolo's not filing taxes in 2008 and 2009, and refusing to report to parole and probation the sale to Vince Piazza of the Philadelphia Crazy Horse Too strip club which netted Rizzolo over $3 million dollars. Instead, Hunterton told the court that Rizzolo and his parole officer without reporting to the court or Kirk Henry began sending donations of $1,000 per month to Henry in "restitution," and that it would take Rizzolo over 750 years to pay off his obligation at that rate. Using this as an example, Hunterton said that Rizzolo's secret $1,000 payments were "emblematic of putting his finger in the eye of the law," and clearly displays contempt for the court - and that Rizzolo if allowed to continue, "wins because his goal in life is to never pay Henry or the IRS." Hunterton ended by saying, "The only thing this man understands is being locked up. He holds this court and Mr. Henry in utter contempt. Incarcerate him!" U.S Attorney Johnson then told the court that the Government agrees with everything Hunterton said. Judge Pro ended the hearing by stating that after the Crazy Horse Too is auctioned off on May 3, Rizzolo's claim that all his debts must be paid from the proceeds from the defunct strip club's sale will be moot, and that Rizzolo will be personally responsible to pay his debts. Rizzolo's attorney Dominic Gentile told Judge Pro, "You have the power (to revoke Rizzolo's parole), but not the authority." "Today is not the day to be pointing twenty fingers." He ended by asking to judge not to change anything until after May 3 when the Crazy Horse Too is sold.
