After successfully stalling unpaid beating victim Kirk Henry's personal injury case for over a year by pretending to be acting as his own attorney, convicted racketeer Rick Rizzolo yesterday was ordered to pay Henry's attorneys only $5,000 in legal fees for having to answer dozens of bogus court filings that bore Rizzolo's signature.
Henry's attorneys had informed U.S. Magistrate Judge George Foley that they had expended over $16,000 in time and resources to answer Rizzolo's Pro Se fillings, but Magistrate Foley only granted $5,000 for their efforts. Rizzolo immediately appealed the $5,000 judgment to the Ninth Circuit Court of Appeals further stalling Henry's case. Doing so cost Rizzolo in excess of $10,000 in additional legal fees according to trial experts.
In the meantime, Rizzolo's ghost writer James Kimsey was charged with contempt of court, and sentenced to three years probation for authoring the documents Rizzolo signed. However, Rizzolo was not charged for affixing his signature multiple times to the bogus documents.

ORDER Motion for Release of Bond (#440)
This matter is before the Court on Plaintiff’s Ex Parte 1 Application for Release of Supersedeas Bond (#440), filed August 13, 2010. To date, no party has responded to the present motion and the time for opposition has now passed.
On February 19, 2010, the Court ordered Defendant Frederick Rizzolo to pay $5,000 to Plaintiff as sanctions awarded under Fed.R.Civ.P. 37. (#286). The Court allowed Defendant to post a bond in lieu of immediate payment as Mr. Rizzolo intended to appeal the matter to the Ninth Circuit Court of Appeals. (#373). On June 4, 2010, Defendant Frederick Rizzolo posted a supersedeas bond with the Court in the amount of $5,000.00. (#395). On August 11, 2010, the Ninth Circuit dismissed Defendant’s appeal of the order imposing sanctions. (#438). Accordingly,
IT IS HEREBY ORDERED that Plaintiff’s Ex Parte Application for Release of Supersedeas Bond (#440) is granted. The Clerk of the Court will release the supersedeas bond directly to Plaintiffs at the address currently on file with the Court.
