The saga of Sam Bankman-Fried will likely be the major domestic news topic of 2024. The liberal media will portray Sam as a sad victim of his own naiveté. A young man who thought he was genuinely doing a good deed. Altruistic and not self-serving. Surrounded by equally naïve young associates. At least two have admitted their guilt.

Sam is a Crypto geek, born of two savvy college professors, who woke-up to the chaos he was causing and admitted he made serious mistakes. A repentant soul. Although he was guilty of misappropriating customer funds, he was innocent of any intent to cheat others. After all, he loves animals. Sam’s even a vegan. Much of the D.C. political class will be equally tolerant of SBF’s “mistakes”. Several pols, of both parties, received gobs of campaign donations from his selfless largess. In short, much of the American media and political classes will be forgiving of SBF and not portray him as a rank fraudster. Which takes me back several decades ago to a conversation I once had with a former Assistant U.S. Attorney. He looked and talked like the actor Morgan Freeman. He said he remembered being in a crowded Federal Court Room when senior executives of Braniff Airlines, that later morphed into Southwest Airlines, were being tried for misappropriating employee retirement funds in their effort to avoid the company going bankrupt. He said that when he looked around the crowded gallery, he realized they were mostly other plaintiff attorneys.

It was a long and tedious trial, replete with complex accounting concepts. He said the testimony was just too difficult for the jury to understand. The result was a hung jury, unable to come to a decision over the guilt or innocence of the Braniff senior executives. In the meantime, he said, down the hall from that court room another trial was underway. It was presided over by Judge Sarah Hughes (d. 1985) who swore-in LBJ on the plane flying back to D.C. after JFK was assassinated in Dallas. She’d been called in from retirement to try a case where a man was being prosecuted for poaching deer on federal land. The jury found him guilty, and she sentenced him to a fine and six months in a federal prison.
