I have written on several occasions about the hypocrisy that surrounds the separation of church and state. I have argued that schools promoting the acceptance of an LGBTQ lifestyle are, in fact, promoting a religion. If you cannot discuss accepting Christianity as a lifestyle, why is indoctrinating people with the idea of choosing an alternative lifestyle acceptable?

A recent press release states that the bill aims to penalize "conversion therapies" that seek to eliminate or deny an individual's sexual orientation, sexual identity, or gender expression. The bill proposes prison sentences ranging from six months to two years for anyone offering these therapies. It considers actions that affect "bodily integrity or physical or mental health, or seriously undermine moral integrity" to be criminal. However, the bill does not provide a precise definition of "conversion therapies," raising concerns that it may also encompass legitimate pastoral care or personal support.

The Spanish Evangelical Alliance (AEE) has voiced its criticism of the proposed bill, claiming it mischaracterizes legitimate pastoral care and personal support as harmful "conversion therapy." They argue that the legislation could penalize individuals who wish to reconcile their gender identity with their biological sex or who choose to leave a homosexual lifestyle. The AEE emphasizes that authentic pastoral support is not manipulative; rather, it is intended to assist those who seek help voluntarily. Additionally, they caution that the law could create a double standard by endorsing one type of gender transition while penalizing those who wish to de-transition.

The AEE board of directors’ states:

“The pattern is repeated: first, the concept is distorted, starting by assigning a pejorative term, such as ‘conversion therapies', and projecting a false image of manipulation and torture treatments, and finally imposing penalties, including intimidating prison sentences. Torture and manipulation in professional therapies or in personal help are already contemplated in the Penal Code and in the Deontological Code of Doctors or Psychologists, and it is not necessary to create new penalties.”

If the bill passes in the Senate and becomes law, it could lead to jail time for pastors, parents, or professionals who provide support related to gender identity and sexual orientation, even if there is voluntary and informed consent. The AEE is dedicated to advocating for freedom of conscience and belief, urging parliamentarians to respect fundamental rights in their votes. This debate highlights the tension between government efforts to combat harmful "conversion therapies" and the concerns of religious organizations about potential limitations on religious freedom and personal choice.

The leading Socialist group’s proposal to jail proponents of so-called “conversion therapies” is based on nothing but lies and is being used to attack Christian beliefs.

“The group argues in the explanatory memorandum of its legislative text that it considers it necessary ‘to raise the punitive response because we are not facing isolated cases but one of the most serious forms of attack and denigration of the LGTBT collective, especially due to the appearance of new forms of dissemination of these self-styled therapies, such as web platforms, social networks, etc.,’ Similarly, this bill seeks to ‘advocate for a world free of the criminalization of sexual orientation, sexual identity and gender expression.’”

If the amendment receives final approval, the Penal Code will introduce Article 173, which could result in the imprisonment of advocates for conversion therapies.

The current wording of this amendment states:

“Anyone who applies or practices on a person acts, methods, programs, techniques or procedures of aversion or conversion, whether psychological, physical, pharmacological or of any other nature, aimed at modifying, repressing, eliminating or denying his sexual orientation, sexual identity or gender expression, shall be punished with imprisonment of six months to two years, with impairment of their bodily integrity or their physical or mental health or with serious impairment of their moral integrity.”

The penalty would be appropriate if the “victim” is a child or acts are committed for profit or using “violence, intimidation or deception,” or “when the offender belongs to an organization or association, even of a temporary nature, which is engaged in the performance of such activities.”

Penalties will also be imposed on those responsible for children or disabled individuals in need of special protection who facilitate the perpetration of these offenses.

Congress added:

“In these cases, when the judge or court deems it appropriate to the interests of the minor or person with a disability in need of special protection, it may also impose the penalty of special disqualification from exercising the right of parental authority, guardianship, or foster care for up to five years.”
