California Federal District Court Judge Roger T. Benitez

Surprise!  Obama Doesn’t Own All of the Judges

My faith in the United States Judiciary has been partially restored. I am now a partial believer that there are judges who do love the United States and all it has accomplished in a mere 234 years of existence. All its goodness and beneficence is known to the world and receives praise for it.

But for the past year or more, while many American citizens have attempted to get resolution on the disturbing circumstances revolving around the Constitutional eligibility, or the lack thereof, of President Barack Hussein Obama to hold such office, a significant number of America jurists have fallen short of their compensated duties of declaring judgment through what has appeared to be sheer cowardice. One such judge had not only accepted the challenge to hear evidence which may have led to the placement of our Chief Executive on trial for treasonous violation of our Constitution and its provisions, and had even scheduled a date and place for such event, only to abdicate his previously announced decision after hiring a new employee who had immediately previously been employed by the potential defendant’s legal team. I have no idea if there is any sort of penalty for such non-judicial conduct on the part of that judge, but if not, then there ought to be as it was as flagrant with abuse as an outright assault. Consciously deliberate dereliction of duty comes to my mind in this case. But many millions of Americans familiar with that incident have hopes that justice will ultimately prevail and that particular judge will feel the wrath of their disappointment through the ruling of another judge. In the meantime a judge has been found in California that actually believes in Constitutional rights and ruled that a teacher may return two patriotic banners to the walls of his classroom after being told to remove them by San Diego, CA School District. Normally a story of this nature would not receive the attention of millions of people, but in times like these when corrupt labor unions and organizations such as the ACLU and other anti-American groups are riding high on the refusals of many judges to resist such groups’ complaints, reasonable people once again take heart. On March 01, 2010 the Thomas More Law Center announced in a TMLC News Alert that “California Federal District Court Judge Roger T. Benitez ruled late this past Friday that the Poway Unified School District in San Diego, CA, violated math teacher Bradley Johnson’s constitutional rights when it ordered him to remove two patriotic banners from the walls of his classroom because they ‘over-emphasized’ God.” That “school officials banned Johnson’s patriotic displays while permitting other teachers to display personal posters and banners promoting partisan political issues such as gay rights and environmental causes, including global warming, played a crucial role in the Judge’s decision.” My joy at reading of this decision of judicial backbone was on a bit of a ‘high’ and thinking that perhaps our legal system of adjudicators was beginning to turn around and we would see more and more fair decisions instead of the time after time heavily biased rulings against patriotism and Christianity. But such was not the case. The very next day after writing the above account of legal fairness I saw this posted on my Internet Inbox: NYDailyNews.com

B'klyn ACORN cleared over giving illegal advice on how to hide money from prostitution

BY Scott Shifrel DAILY NEWS STAFF WRITER Monday, March 1st 2010, 4:10 PM After the introduction paragraphs came the prosecutor’s statement: "On Sept. 15, 2009, my office began an investigation into possible criminality on the part of three ACORN employees," Brooklyn District Attorney Charles Hynes said in a one-paragraph statement issued Monday afternoon. "That investigation is now concluded and no criminality has been found." Was there any sane person in this country that expected any different finding for those “saintly” ACORN’s? So it’s back to ‘Square One’ on getting judicial bravery in the U. S.
