Sex for Testimony in Ted Stevens Case

The injustice against former Senator Ted Stevens is a story of sex, cover up, and corruption



The admission of wrongful conviction of former Senator Ted Stevens (AK) today by Attorney General Holder does not close the issue but only raises many questions. It now appears likely that the prosecution team not only withheld exculpatory evidence which would have exonerated Senator Stevens but also concealed knowledge of an ongoing inappropriate sexual relationship between the head FBI agent and the star prosecution witness who received a special deal in his own prosecution. Was this information specifically withheld until after the general election to have political consequences?

On July 29, 2008 the longest serving Republican Senator, Ted Stevens (AK) was indicted by a Federal Grand Jury in Washington DC for hiding gifts from wealthy Alaskan and CEO of VECO, Bill Allen. Matthew Friedrich, the chief of the Criminal Division for the Justice Department went on a media appearance spree including an extensive appearances on MSNBC Countdown and Verdict proclaiming that politics had nothing to do with the case. He boldly proclaimed to Bloomberg at a special Washington press conference he called together to showcase the pre-election arrest that "That policy has been followed to the letter in this case. During the first week of October 2008 almost a month before the national election U.S. District Judge Emmet Sullivan suspended the trial of Senator Ted Stevens when his defense attorney's Williams & Connolly had discovered that the prosecution was holding records collected by the FBI that could potentially aid in his defense. Unfortunately the truth about who was really corrupt would not yet be revealed. At that time the judge ruled in favor of the prosecution leading to Senator Stevens conviction. As first reported by Mike Scarcella in the Legal Times, the primary witness against Stevens, Bill Allen, was key to the case because his testimony demonstrated whether Stevens received repairs to his home as illegal gifts or just as the defense claimed was never appropriately billed. The lead prosecutor, Brenda Morris, was in fact holding evidence that supported Steven's contention that he did in fact intend to pay for all repairs billed and directly refuted Bill Allen's testimony. There was one very important additional bit of information that Prosecutor Morris did not offer. The lead FBI agent in charge of the case, Mary Beth Kepner, was having an inappropriate personal relationship with the prosecutions star witness. Bill Allen received a special deal from the prosecutors in return for testimony against Senator Stevens and also was treated to nightly visits in his hotel room by FBI agent Kepner. This discovery of the inappropriate relationship did not come to light until after the election and the conviction of Senator Steven. Members of the prosecutorial team hid the truth until in December when another FBI agent, Chad Joy, exposed the "inappropriate relationship". According to the Anchorage Daily News, Joy reported that Agent Kepner rewarded Allen for his testimony at the Steven's trial by wearing short skirts. He went on state that for other witnesses she has received gifts, entertained them at home alone, and even got a job for her husband as a security guard. In February District Judge Emmet Sullivan for the District of Columbia who had been delaying sentencing to further investigate charges of prosecutorial misconduct found the prosecution team of William Welch, Brenda Morris, Nicholas Marsh,Edward Sullivan, Joe Bottini, and James Goeke in contempt of court. He ordered that new a prosecution team replace them. Amazingly it took until today for the new Attorney General, Eric Holder, to admit that a terrible injustice had been committed against former Senator Ted Stevens. Although many on the left are lauding his decision as a merciful one because the Senator was old this was not a question of mercy but of justice. Attorney General Holder had no choice but act swiftly now so as not to be caught up in the coming firestorm. Justice still demands that an immediate and in-depth investigation be carried out of the Stevens case. The evidence so far seems to clearly suggest the prosecutors knew early on of the inappropriate relationship and exculpatory evidence against Senator Stevens. Why did they hide it until after the general election? Why did it take a whistle blowing FBI agent to finally come forward with the truth? What did Matthew Friedrich really know and was he truthful when he was appearing on MSNBC? Mr. Friedrich held a special meeting with reporters to tell them that the investigation was continuing to find others involved following the conviction of Stevens but yet he never revealed if his investigation revealed the wrongdoing of those directly under him. Marc Begich, the Democrat who defeated the wrongly convicted Stevens by 1% of the vote received tens of thousands of dollars from lawyers, legal lobbyists, and organizations such as the American Association of Justice according to the Center for Responsive Politics. What is the relationship of the members of the prosecution team who were involved in the cover up to the organizations who donated to the campaign of Marc Begich? Many questions need to be answered before this case can rest.
