The real threat to American democracy is the left’s anti-democratic legal theories to “Get Trump”

Just before Christmas, the seven Democrat-appointed Colorado Supreme Court justices delivered coal in America’s stocking. In a 4-3 ruling they held that former President Trump is disqualified as a presidential candidate by the “Insurrection Clause” of the 14th Amendment.

This comes as polls show Trump with an insurmountable lead over Republican Primary challengers and beating President Joe Biden if the election were held now. Just months ago, this insurrection clause theory was seen as a fringe attempt to take Trump off ballot, and it’s important to understand the partisan backing: “The board chairs of the group that brought the lawsuit leading to former President Donald Trump’s Removal from the 2024 Colorado ballot had previously donated large sums to President Biden's campaign and victory fund.”

Those going after Trump found (arguably) the most Democrat-leaning state court in the nation to achieve the narrow, split opinion “victory.” In one sense, this is an un-American attempt by one party using questionable legal theories to deprive Americans of their vote (what’s now the basis of indictments against Trump and other lawyers). Even more un-American is the Left’s argument the Insurrection Clause is self-executing. This is legally incorrect, and will end Democracy if not stopped.

The slim Colorado Majority’s “finding” is that alleged “evidence” of insurrection includes Trump’s pre-election political assertion “the only way they win is if the election is rigged” and other such dubious grounds. The Majority held the partisan Jan 6 commission (with edited video coverage, double and triple hearsay cherry-picked “testimony,” and biased conclusions) is authoritative to an insurrection occurring and held no further due process is needed.


Thankfully, Justice Samour slammed the lack of due process in his dissent: “In the first American Declaration of Rights in 1776, George Mason wrote that “no free government, nor the blessings of liberty, can be preserved to any people, but by . . . the recognition by all citizens that they have . . . rights, and that such rights cannot be enjoyed save in a society where law is respected and due process is observed.’ Va. Const. art. I, § 15. Some two and a half centuries later, those words still ring true

“In 2023, just as in 1776, all … are entitled to procedural due process. Because I cannot in good conscience join my colleagues in the majority in ruling that Section Three is self-executing and that the expedited procedures in our Election Code afforded President Trump adequate due process of law, I respectfully dissent.” [Source].

Justice Samour’s dissent also makes the point that around a year after the passage of the 14th Amendment, renowned Chief Justice of the U.S. Supreme Court, Salmon Chase, decisively obliterated the argument the Insurrection Clause was self-executing.

The Left’s argument of the self-executing nature of the Insurrection Clause is catastrophic to democracy by bringing “banana republic” tactics both parties will use. Beyond near complete agreement on the political right that January 6 was not an insurrection (the only person killed with a weapon by another during the January 6 riot was unarmed female protester Ashley Babbit by a Capital officer), many of those on the left believe it was not an insurrection.

For example, famed liberal and self-identified Democrat law professor Alan Dershowitz, who voted for Biden both times, claimed January 6 was not an insurrection. He went further in explaining the way Democracy will be undermined by taking Biden’s position: “This is an attempt to totally manipulate an amendment that was never designed to disqualify people in future election, Texas will try to take Biden off the ballot, saying he lent support to an insurrection by opening the borders—an absurd argument but not much more absurd than the argument that the four justices of the (Colorado) Supreme Court.”

Despite the national disagreement over what to call Jan 6, Joe Biden exclaimed after the dubious split opinion that Trump’s guilt for insurrection was “self-evident.”


As we all saw January 6, the American people are the appropriate body to determine what’s “self-evident” and not Trump’s challenger.

Taking the position of the Left with the self-execution of the insurrection clause, many Democratic politicians will be stripped from the Ballot, starting with Kamala Harris. During Antifa/BLM rioting in the summer and fall of 2020, Americans watched as Federal Courthouses were attacked by the political left repeatedly over many weeks injuring many officers. The White House was attacked, forcing President Trump to be taken to a bunker for his safety as protesters wounded dozens of Federal agents.

Those riots directly caused the deaths of dozens, including law enforcement, and brought billions in damage and theft. Meanwhile, Senator Kamala Harris helped bail out rioters and claimed they “shouldn’t” stop.

Though the Supreme Court will likely overturn the Colorado ruling, we as Americans need to demand the left stop attempting to destroy our systems to “get Trump”. To beat Trump, find the right candidate and convince the people to vote against him. We are meant to be one nation, under God, and it’s time to demand the Democratic Party act like it.
