Congressional Democrats who have spent the past four years fixated on the Constitution’s emoluments clause might want to focus on another portion of our nation’s founding document. Article VI, Section 3 states that lawmakers and federal employees “shall be bound by Oath or Affirmation, to support this Constitution; but no religious test shall ever be required as a Qualification to any Office or public Trust under the United States.” This passage could end up front-and-center in the Senate hearings over Judge Amy Coney Barrett’s nomination to the Supreme Court.-- More...
