U.S. Judge issues new ORDER in Rizzolo case

On September 9, attorneys for unpaid beating victim Kirk Henry filed a MOTION to either extend racketeer Rizzolo's parole past its expiration in April 2011, or to send him back to federal prison for refusing to abide by the provisions of his April 2008 parole.

In 2006, Rizzolo plea bargained with U.S. Attorney for Nevada Dan Bogden for a shortened prison sentence in exchange for Rizzolo's promise to pay Henry $9 million dollars, and to pay the IRS just over $4 million in back taxes, penalties, and interest. Rizzolo has not paid one cent of his promised restitution to Henry, and now owes the IRS over $6 million including new penalties and interest. In the meantime, Rick Rizzolo and his ex-wife have transferred their fortune to the Cook Islands with the help of the brother of a local federal court judge. The responsibility for assuring that the Rizzolos are paying their obligations was placed on the Nevada Department of Parole and Probation, and parole officers Christiansen and Mastrangeli. However, according to the September 9 MOTION, Christiansen and Mastrangeli are "either unwilling or powerless," and "the Government has taken no action to enforce Rick Rizzolo's conditions of supervised release." Based on Kirk Henry's MOTION, Presiding Judge Philip Pro issued his ORDER. In response, it will be interesting to learn if the IRS has forgiven the Rizzolo's tax burden, and if the Dept. of Parole will describe him as a model parolee. - SM image
