Time For The American Bar Association To End its Democrat Party Bias

With the flurry of Executive Orders signed by President Trump and DOGE audits, the Democratic Party bias of the American Bar Association (ABA) has become clear. After the Trump Administration tried to temporarily freeze USAID foreign aid during a DOGE audit, ABA President William Bray asserted “The American Bar Association cannot overstate the impact of this unlawful course of conduct.” (American Bar Association)

After a member of Congress voiced an impeachment threat against a judge hindering DOGE, the American Bar Association condemned the threat. When Trump signed an Executive Order (EO) suspending the security clearances of attorneys a Democrat aligned “white shoe” law firm, Perkins Coie, the ABA condemned Trump’s action. Due to the Democrat and progressive bias of the ABA, Republicans in Congress are trying to restrict the ABA from the judicial vetting process (Fox News, March 8, 2025)

The real problem is not that the ABA speaks out against what it perceives as harmful to the legal profession. The problem is that the ABA remains silent about the lawfare and worse committed by the Democratic Party while targeting Republican actions. It’s important to note that only 28% of American lawyers are members of the ABA. I have practiced 20 years and am not a member and I don’t personally know any conservatives in the organization. The ABA did not offer a word of criticism about lawfare waged by the Biden administration against Trump.

ABA aligned lawyers, including several lawyers at Perkins Coie, helped Hillary Clinton’s campaign pass the phony Steele Dossier to the FBI and spent years pushing the phony “Russian Collusion” narrative to destroy Trump and his family.

The ABA offered no criticism after the Russian Collusion hoax had ripped the nation apart. Trump’s support from the American people continued even after Trump was first indicted and then as they understood what the ABA refused to condemn (note: A Rasmussen Poll taken after the indictment showed Trump went from trailing Biden 45-42 to overtaking Biden by seven points (47-40) after the indictment (Daily Mail, April 5, 2023 ).

As Historian and Author Victor David Hanson described the ensuing misconduct by prosecutor Alvin Bragg bringing the indictment: “At least two left-leaning federal and state prosecutors (and the FEC) previously have passed on the same evidence Bragg is now using for his indictments.

They have explained that such a prosecution is infeasible because of statutes of limitations, because of a state attorney improperly appropriating the role of a federal prosecutor, and because non-disclosures agreements are a fact of life and not strictly illegal… Bragg’s chief witness, Michael Cohen, is a felon and confessed liar, with a deep personal hatred of Donald Trump—a fact well known to all potential prosecutors.” (Real Clear Politics, April 3, 2023)

Victor David Hanson went further describing scandal the ABA would not criticize: “Trump did not violate federal law, as did Hillary Clinton, by destroying federally subpoenaed emails and devices in order to hide evidence….. sending classified government communications on her own, through an unsecured home-brewed server…… hiring—through three paywalls—a foreign national, who is prohibited from working on presidential campaigns, to compile a dossier to smear her presidential opponent….. hiding her payments (as “legal services”) to Christopher Steele through bookkeeping deceptions….. Bill Clinton, use(d) a crony to search out a high-paying New York job for a paramour in order to influence her testimony before a special counsel.”

As to the Bidens “Trump did not, as the Bidens did, set up a family consortium to leverage monies from Ukraine, Russia, and China, on their shared expectations that he might soon run for and be elected president and become compromised…Joe Biden (is mentioned) in family business communications as a recipient of a 10 percent commission on such payoffs…. Joe Biden, removed presidential papers—without any authority to declassify them—and (left) them.. unsecured in a garage.” (Real Clear Politics)

The ABA’s condemnation of suspending the security clearances of Perkins Coie lawyers contrasts with their silence on the Democrat attempts to disbar all lawyers who represented 2020 election challenges. As described by The Hill “A dark money group with connections to the Democratic Party (“65 Project) is reportedly looking to disbar and discredit more than 100 lawyers who worked on former President Trump’s post-election lawsuits…. the idea was to ‘not only bring the grievances in the bar complaints, but to shame them and make them toxic in their communities and their firms’.” (The Hill, March 7, 2022)

This was a disgusting attempt to destroy the lives of countless conservative lawyers. Perkins Coie lawyers solely faced losing a security clearance which few lawyers have (In disclosure I have a security clearance from three decades of military service but don’t use it). Like so many other institutions which lost the trust of the American people in recent years due to progressive ideological bias, the ABA needs to reform itself and regain trust. Americans expect the ABA to act as the voice of the entire legal profession, and not just the voice of the Democratic Party. In short, it must become the truly professional and therefore apolitical guardian of the legal profession and the justice system. A sacred system which holds that all Americans are created equal by God and entitled to blind and truly fair justice.
