This article misses what our teaching of law and history have missed. The law of England was in two parts, a common law for general support of productive and peaceful people, and a higher law for running the government. Treason only addressed the higher law that served governance.; but the only law effective in the newly formed states was the Common Law,; the King's higher law had been denied through revolution. The provisions in our Constitutional document addressed to treason replaced one aspect of that higher law without having the sovereignty of English governance as a basis. I note that this also addressed the definition of "high crimes and misdemeanors' in a way that our courts did not follow in modern impeachment activities.
