Can you imagine being accused of a crime when you are innocent? Let's pretend, for argument's sake, that you have been accused and let's call it murder. . . . .
The police come to your door, handcuff you, take you to jail and book you, all without any evidence that you may have actually committed the crime. Your next-door neighbor, who has hated you from the moment you moved in simply calls the police and informs them that you murdered his wife and they take his word for it, without any due process.
According to the laws of the United States, you are presumed innocent until proven guilty. After all, you might just be innocent and you should be allowed to defend yourself in a court of law, judged by an impartial jury of your peers. Your entire life IS on the line.
You sit in jail, not allowed to call your attorney. All the local television stations interview your neighbors and report, non stop, that you are guilty of murder. The local newspapers spread it across the front page, that you did, IN FACT, murder your neighbor's wife. Every Sunday "chat" show on CBS, NBC, MSNBC and CNN discuss the case, further assuring the public that you committed a heinous crime and should be thrown in jail for the rest of your life. Add insult to injury, they don't call you for a comment and refuse to allow you or any of your family and friends to defend their accusations.
Your trial date finally comes and you have your attorney in place. (His bill is already more than the current value of your home, which you will be forced to sell in order to pay his fee.) It's now your chance to prove your innocence. You now have the opportunity to bring in witnesses that can prove, without a shadow of a doubt, that you are innocent and your neighbor killed his own wife. In your mind you relish the thought of filing a law suit against your neighbor when this witch hunt is exposed for what it is and you can get your life and your bank account back. However, when the trial begins, the judge walks in and reads the rules of your trial and they are as follows:
The prosecutor, who is determined to see you in jail, can hold secret meetings discussing the case with those who have accused you, and present this evidence to the judge and jury before trial. They also have full authority to decide whether any of your witnesses or evidence will be presented to the court and whether or not you will be allowed to access the testimony of his witnesses.
The prosecutor and his team can chose to release tidbits of this so-called behind door evidence to the public, but only the parts they deem will help their case.
The prosecutor and his team are allowed to present their case to the judge and jury in private without your input or presence.
While your lawyer has lined up many witnesses that can absolutely prove your innocence while confirming guilt of your neighbor, the prosecutor and his team have the right to approve your list of witnesses and deny any that they feel are not necessary to their case.
The prosecutor and his team can submit additional written evidence throughout your trial, real or not, to the judge and jury sitting on your case, without your knowledge, presence or approval.
The prosecutor and his team have the right to decide whether any evidence you have will be allowed during your trial.
The prosecutor and his team are allowed to deny any and all of your witnesses and set the trial in motion with only hostile witnesses, who are anxiously waiting to see you in jail.
The prosecutor and his team have the right to question their witnesses and yours, (if you were allowed to have any) and can decide whether or not you can cross examine your accusers.
The prosecutor and his team are allowed to give a closing statement to the judge and jury, summing up your absolute guilt through their so-called evidence, even if its based on hearsay or an out and out lie.
The prosecutor and his team have the power to decide if your attorney will be allowed to offer a closing statement at all.
You are quickly found guilty while never having the opportunity to even speak present witnesses or cross examine your accusers.
You are guilty, until proven guilty.
Can you imagine this ever happening in the United States? Well, guess what. It is happening right now in our Congress led by Nancy Pelosi and Adam Schiff. They have elected themselves as judge and jury and have taken it upon themselves to decide on the rules of the game.
