Unpaid beating victim Kirk Henry, still waiting 9 years later

Kirk Henry asks for Protective Order against Lisa Rizzolo



In a MOTION FOR PROTECTIVE ORDER filed a few moments ago in United States Federal Court, unpaid beating victim Kirk Henry is asking the court to quash a subpoena demanding that he appear in Las Vegas on March 11, to be deposed by attorneys representing racketeer Rick Rizzolo's ex-wife Lisa.

In the subpoena, Lisa's attorney states that Henry's presence in Las Vegas is necessary so they could "evaluate his demeanor and credibility as a witness." In his MOTION FOR PROTECTIVE ORDER, Henry asks that his deposition be taken by telephone based on the extreme hardship and expense of a quadriplegic having to travel out of state. Lisa's attorneys had previously refused Henry's request stating that they would only allow a telephonic deposition if Henry agreed to not be present at the Rizzolo's jury trial scheduled for late this summer. The Henrys have waited over nine years for their day in court. So their MOTION argues that Lisa's demand that they not attend their own trial is totally unacceptable. Therefore, Kirk Henry believes he has no other choice than to ask the court to protect him against such an unreasonable and cruel demand. Read the entire MOTION here:
