Congratulations on your election. For the sake of our country – and, indeed, the world, I wish you and your administration success.
Throughout your campaign you spoke of implementing an administration of change; of listening to the common person’s needs and issues. I think most people have grown weary of most politicians, both Democrats and Republicans. Most of us are desperate for real service with backbone, with honor.
You have an opportunity to make a decided difference with regard to a glaring injustice. Action from you regarding this issue would captivate and inspire most of the people in the United States, especially those who have been following this horror for years.
For the last two years, two honorable US Border Patrol agents, Ignacio Ramos and Jose Compean, have been incarcerated, locked in solitary confinement. As you may know, the problem revolves around their confrontation with a legally recognized drug smuggler and illegal alien, Asbaldo Davilla, at the Southern border in February of 2006, who after transporting over 700 pounds of illegal drugs into our country, was discovered and chased by the two agents. A confrontation occurred and shots were fired at the scene. The only witnesses were the illegal alien drug smuggler and the two popular, decorated and highly respected agents. The agents’ position was that they believed he was pointing a weapon at them. They saw something silver, which, to the both of them, looked like a gun so they fired after a physical altercation which took place between Mr. Davilla and one of the agents. They detected no evidence that any of their shots has hit Mr. Davilla due to the facts that: a) Mr. Davilla kept running to a getaway car, and b) there was no blood trail.
Naturally, as the facts of the case unfolded, Federal Prosecutor Johnny Sutton chose to portray Mr. Davilla as the victim even though it was Mr. Davilla who was intercepted breaking several US federal laws. This avenue of prosecution held only Mr. Asbaldo’s opinion to challenge the sworn testimony of the two experienced agents; agents sworn to uphold the law. Mr. Davilla was given immunity to testify against, Subsequently, after testifying against Agents Ramos and Campean he was arrested for yet again for the illegal transportation of illegal narcotics into our country.
The simple question – and a question that is begged to be asked – is this: Whose word would you trust, Mr. President?
To add insult to injury, to tarnish yet further the careers of Agents Ramos and Compean, they were convicted (and lost on appeal) even though the evidence provided was the word of a “drug mule,” and a repeat offender at that. Mr. Davilla has since been convicted for drug related offenses since the original trial.
As Mr. Asbaldo healed from the shot that hit him, Agents Ramos and Compean were wrongly convicted by an aggressive federal prosecutor and his abuse of a law meant to address the misuse of firearms by those other than law enforcement officers, especially those who are faced with mortal combat and dangerous altercations. Agents Ramos and Compean have been wrongly imprisoned, in solitary confinement for over two years of their 11 and 12-year sentences, due to the prosecutorial misconduct of Mr. Sutton.
Mr. President, you have the power to right this horrible in justice. A plethora of requests for the pardoning of these two dedicated law enforcement officers; the requests spearheaded by US Rep. Poe, US Rep. Rohrabacher, former US Rep. Duncan Hunter and over 100 co-signers. Former President Bush has ignored all calls for mercy, pardon or commutation, yet President Bush granted 190 pardons and 9 commutations; 31 awarded to those with convicted drug violations.
Countless hundreds of thousands in this country would like to know why pardons were facilitated for those who knowingly transgressed the laws of our nation while two dedicated law enforcement officers were convicted on the word of a convicted drug trafficker. Mr. Davila ran off and recovered from wounds well enough to resume his illegal drug trafficking bringing drugs into this country that reach the streets that your daughters my very well find themselves on one day. Yet, our protectors, Agents Ramos and Campean, have been deemed guilty of crimes. Has this injustice been accepted by your administration? Have they been forgotten, sir?
For detailed facts on this case that reflect what has been stated in this letter, please contact US Rep. Poe, US Rep. Rohrabacher and recently retired US Rep. Duncan Hunter. They and many others in Congress who have championed the many pardon efforts for Agents Ramos and Compean have tried to right this incredible injustice and misuse of the law. I pray, Mr. President, that you will not turn a deaf ear to the pleas of these innocent men, this dedicated public servants, and their supporters as, sadly, former President Bush has done.

In fact, I fought against your candidacy in many ways. But today I stand to acknowledge you as my President and I will agree and support you where I can while reserving my constitutional right and challenge and disagree with you where issues warrant. I don’t wish you to fail, my hope for you and your administration is exactly the opposite. I will be praying for you and our country.
I beg you, sir, to do the compassionate, honorable and right thing regarding these two dedicated public servants, public servants suffering the brutality of solitary confinement. Please pardon or commute their sentences. The country awaits an honorable solution to this ongoing legal nightmare!
