In law there’s a metaphor referred to as “fruit of the poisoned tree”. It describes evidence gathered from information obtained illegally. The logic is that if the source of the evidence (the "tree") is tainted, then anything gained from it (the "fruit") is also tainted
It’s our belief there’s a parallel to be drawn between the evidentiary and the practical. We suggest: if a person is an alien illegally living in the United States, in open controversy to states laws and national immigration laws, statutes and/or policies and dictates; and further that this person has made NO effort to renounce their native citizenship or seek asylum from harm resident in the land of their native citizenship they should be deemed Illegal Aliens and subject to laws governing their continued residence or deportation from the United States. Therefore any child born of the illegal alien while illegally residing in the United States under the aforementioned definition holds the citizenship of the birth mother. (The child becomes the FRUIT of the Poison Tree.)
Because the person has illegally crossed over the border and taking up residence without proper legal authority, civil and criminal statutes have been violated. This then becomes an enforceable matter under ICE statutes and immigration law.
It was never intended that aliens should garner the benefits of American citizenship without proper procedural controls and enforcement. American Indians were not allowed citizenship until the Indian Citizenship Act of 1924 was enacted during the Coolidge Administration. Thus illegal aliens have not ever been afforded the “rights” of citizenship without the abrogation and setting aside of statute law by those not empowered to do so, (Executive and Judicial Branches acting without mandate of written enacted legislation.)
It’s to be recognized that states such as Arizona and others, have enacted laws to protect their local citizenry from the economic and criminal impacts of illegal entrants into their state borders. These laws in some cases mirror extant Federal Statutes in their verbiage, construct and stated purpose. But the Justice Department (under the questionable legal expertise and lesser leadership skills of the Attorney General) has challenged the people in jeopardy when and where this jeopardy becomes apparent as they try to protect themselves. The public servant seeks to become master of the public in this matter and overrules the popular vote and direction of the populace.
The Plutocratic Assembly of Bureaucratic Nonsense Peddlers has removed the teeth from rightfully enacted laws designed to protect American citizens from Non-Americans. The Federal Government a cobbled together, hodge-podge amalgam of like minded liberal bureaucrats directs the movement from law to accepted, misdirected policy without external oversight or Balance of Powers.
We decry the presence of terrorists plotting the downfall of American government while allowing the progressive destruction of the American Economic system by a hemorrhage of illegally earned money leaving the country to areas beyond our shores. The bureaucrat’s political speak wastes time and leads to rewarding law breakers by regularly giving them amnesty for their violation of those laws.
The liberals, both left and right of the two-party Line of Demarcation, exercise the emotionally over-charged plea/argument of: “if there is true concern that illegal immigrants are storm trooping our borders, let’s leave the babies alone.” (© Diane DeLugan J.D. ezinearticles.com 12/10/2010) Aside from the mealy mouthed, lukewarm appeal for “the babies” the abject Political Correctness is insulting in its drizzling treacle tinged pleading. It implies all the people involved have the best interests of the children involved at heart. All of them don’t.
Unfortunately, in too many cases involving International Conflict and even descending to the level of Domestic Violence, children have been used purely and solely for the advantage of the parent seeking escape from responsibility and the bargaining chip allowing them dominion over their circumstances. Ask any street cop.
It would be nice to believe parents always look out for the better interests of their children. Unfortunately, in the real world liberal criminal enablers refuse to see, having babies has benefits no real, honest, caring parent would consider.
It’s time to prune the poison tree.
