The Right to Life Entwined With the Bill of Rights

Today is Bill of Rights day, but it is likely that it will glide by most Americans as they rush to and fro in  their daily routines. It arrives in the wake of the death and destruction of killer tornadoes that ripped through six states across the Midwest and the South last Friday night into Saturday morning. It is likely that it will not be noticed in comparison to the challenges of struggling to survive in a very dangerous environment in 2021. Especially, the current toxic political environment of the United States, presents a clear and present danger to American citizens "unalienable rights" as outlined in the Bill of Rights to the U.S. Constitution. Unfortunately, only a portion of citizens may even view this as significant to their daily reality. Yet, without "unalienable rights" from God, our struggle to survive has relatively little meaning.  

Defend the right of life and liberty to the unborn

An essential question at the end of this turbulent year is whether the Bill of Rights still matters  to the average American. Before the national election in November of 2020, I wrote that it was "unlike any other election year - it represents a turning point in the history of the United States  of America." Indeed, it has been shown to be so in the aftermath of that election. Currently, what is at stake is the very soul of America, likely America's legacy further into the 21st century, and possibly its future survival. It is not just a cynical observation. There are many symbols that are showing the proverbial "handwriting on the wall." And, it is most unfortunate that many intelligent people are either unaware of the nations' pending existential threat, or they are 'too polite' to discuss it, or not courageous enough to deal with such a threat.   It is likely that only people of faith would see the signs or symbols and care enough to address such a threat and courageous enough to confront the threat to the Republic. Today in America, there are those who hold themselves up as 'leaders,' and expect the public to respect them as leaders who may even be complicit in assisting in the demise of the Republic. We observe a President of the United States who cannot remember the essential words of the Declaration of Independence, let alone the fundamental concept that the rights of the people are "unalienable rights" given to citizens from God. Those rights were codified into the Bill of Rights in the Constitution and are presumably protected by the government, not hindered, nor removed by the government. A real test of courage has recently come before the respected 'leaders' in comprehending the Law of the Land. It remains to be seen whether the Supreme Court justices will stand to defend the right of life and liberty to the unborn.

At the beginning of December the Supreme Court started hearing opening arguments in the Mississippi abortion case, Dobbs v. Jackson Women's Health Organization, which had been placed on the agenda this past Spring. Nevertheless, the high court won't likely issue an opinion in this case at the end of its term, in June of 2022. Those who are in favor of the abolition of abortion view the odds of the five conservative-leaning justices being inclined to uphold the Mississippi law that bans abortions at 15 weeks of pregnancy. Currently, courts understand that legal precedent prohibits outright bans on the abortion of a living being before "viability," which  is legally around 24 weeks in the United States.  What "experts" have previously written into their legalese is that the 24 weeks of "viability" is the time when a fetus could be capable of living with or without medical support outside the womb. This concept of "viability" is essentially what the "experts" have pleased themselves in determining what is "truly" human and what living entity can be trashed. This was a more careful refinement of the Roe v. Wade decision in 1973. The subsequent revision of the right to be able to terminate life within the womb came in 1992 when the Supreme Court ruled in Planned Parenthood v. Casey, that the right to abort a fetus is fundamentally the right to terminate a "pre-viability" pregnancy without interference from the government. This is precisely what Dobbs v. Jackson is focused on: whether government should guarantee abortion on demand, and that usually includes public funding of abortions. This specific case is a challenge to the Mississippi law that bans all abortions after the fifteenth week, unless there is a threat to the life of the pregnant woman.

In one symbolic sense, America's future is linked to this court case

It is a most significant case of whether the states have a right to resist the federal ruling in Roe v. Wade that permits abortion across the nation. It is, however, possibly the silver bullet to Roe because the seminal question being argued is the very "right" to be able to terminate the life that exists within the womb. Yet, this decision goes well beyond some arbitrary right to kill one's baby. While the pending decision may have long lasting impact upon the nation, the real essence of what may be decided before the high court is whether America will be able to endure as a nation of laws rooted in God's principles, or whether our nation will abandon, essentially destroy, our ideals. Christians and conservatives and assorted patriot groups are watching with keen interest whether the Supreme Court Justices will "do the right thing." The argument of those who advocate the right to kill one's baby have made the case that since the legal precedent has now been established for 48 years, it is untouchable, as it has stood the test of time. But, this point is quite weak because it only means no one was strong enough to stand against such an immoral law. It says more about the level of naive trust in the previous Supreme Court Justices to "do the right thing." On a larger scale, the perspective on laws and the legal opinions of attorneys and judges and justices have drifted with the winds of time far from the deeper sense of moral integrity that had inspired our Founders to fight to create a government of the people to protect the "unalienable rights" given to people from God. As Christmas approaches, this is more easily understood. We are the recipients of many gifts from our Creator, one of them happens to be life itself. Many people from all over the world, throughout the course of history have understood that life itself is precious. Sadly, more and more atheists filled to the brim with their anemic beliefs that there is no God have become a real danger to the Republic. In one symbolic sense, America's future is linked to this court case. Are we still a Christian nation, or have we become a nation intent on self-destruction? In this decision that the Supreme Court Justices will eventually make regarding the right to life, they are likely deciding whether to abort the Republic as it exists, or whether we keep it. Yet, "We the People" may have the final say in keeping the Republic.
