THE TRANSGENDER CONUNDRUM

In order to maintain objectivity when we turn to the controversial subject of Transgenderism, it is expedient that the dictionary definition is used.
Definition of transgender : of, relating to, or being a person whose gender identity differs from the sex the person had or was identified as having at birth especially: of, relating to, or being a person whose gender identity is opposite the sex the person had or was identified as having at birth

he reverse could be true as well. In that case, the person would have the blood chemistry and anatomy of a woman but identify as a man. In the case of transgenders, the conundrum becomes apparent when the basis of reasoning centers upon the question: What caused the transgender to identify with a sex that has a differing blood chemistry and anatomy than the individual was born with? There are two opposing positions one can use to explain the phenomenon: One is the line of reasoning that maintains that even in its infancy, a transgender identifies with the opposite sex. There is scientific evidence backing up the claim that transgender brains are different than non-transgenders: This study is the first "to show a female brain structure in genetically male transsexuals and supports the hypothesis that gender identity develops as a result of an interaction between the developing brain and sex hormones." This causes a conflict that can only be resolved by maintaining that a transgender has no choice in the matter, that the transgender will identify with the opposite sex for life, even against the norms imposed by society at large. The other position states that the transgender may identify with the opposite sex at any time, giving the individual a choice in the matter. Planned Parenthood notes that many people identify with the opposite sex when they are young, while others may not start identifying until adulthood.   These opposing lines of reasoning create a conundrum, because each can stand on its own merits and be perfectly valid when viewed objectively.

The Miriam-Webster dictionary definition of the word "conundrum" makes this clear: a: an intricate and difficult problem He is faced with the conundrum of trying to find a job without having experience. b: a question or problem having only a conjectural answer … the political conundrums involved, particularly the problem of how the richer areas … can be made to subsidize the poorer. — Douglass Cater
The dictionary definition is fine when theoretically viewing the matter through the lens of current social norms. However, it does nothing to erase the conflicts created through the two opposing positions stated earlier. There is a way to resolve these conflicts, but the resolution must be based on the acceptance by society in general.  This agreement can emerge only if the general population of citizens change their current paradigm to one that reflects objective reality and eliminates anything that is contrary to this new reality. The current paradigm tells us that in order to fit in, we must believe that individuals can choose their sexuality, and if they choose to be a transgender, they will face discrimination.
"Transgender discrimination is a serious issue in the U.S., with as many as 78 percent of all transgender people reporting that they’ve experienced at least one type of harassment or mistreatment at work. It can involve things like an employer’s failure to hire someone, demoting someone, or even firing someone because they’re transgender."

Discrimination against transgenders is unconstitutional. ‘In Bostock v. Clayton County, Georgia, No. 17-1618 (S. Ct. June 15, 2020),[1] the Supreme Court held that firing individuals because of their sexual orientation or transgender status violates Title VII’s prohibition on discrimination because of sex.  The Court reached its holding by focusing on the plain text of Title VII.  As the Court explained, "discrimination based on homosexuality or transgender status necessarily entails discrimination based on sex; the first cannot happen without the second."  For example, if an employer fires an employee because she is a woman who is married to a woman, but would not do the same to a man married to a woman, the employer is taking an action because of the employee’s sex because the action would not have taken place but for the employee being a woman.  Similarly, if an employer fires an employee because that person was identified as male at birth but uses feminine pronouns and identifies as a female, the employer is taking action against the individual because of sex since the action would not have been taken but for the fact the employee was originally identified as male." The new paradigm teaches us that, because of their inherent tendencies, transgenders are for the first time openly revealing their true nature―not only identifying with the opposite sex, but creating new constructs. For example, they may identify as a cisgender, or binary gender.  In the new paradigm, society must accept that transgenderism is evolving, that they are beginning to identify with more than one gender. Because a transgender will automatically identify―for reasons previously stated―with a gender differing from the blood chemistry and anatomy of the sex they were born with, then it seems only fair that they, as a member of a free society, partake of the same rights given to non-transgenders. For the new paradigm to be effective in resolving all conflicts, changes must be made in how our society functions. For example, the old paradigm maintains that no transgender students should be included with the non-transgender students on the women’s high school basketball team because that would give the team an unfair advantage.

The new paradigm, on the other hand, would allow it because there are no winners or losers, because if there were, that would put too much pressure on the teenage girls already on the team. The question boils down to: Are you willing as a parent to trade merit for equity? The answer to that question is complex, but if one possessing a basic understanding of the terms "equity" and "merit" can realistically asses the best way to resolve all the conflicts. Take professional women’s sports for example. In this case, the new paradigm would agree with the old one. How is this possible? It is possible because the new paradigm maintains that women who are biologically male would be barred from the team regardless of their capabilities. In fact, it is those very capabilities that would make it impossible for a transgender to be on the team because of the unfair advantage it would create.

TWO EXAMPLES OF DISCRIMINATION AGAINST TRANSGENDERS

"1. Termination or denial of opportunities Some employers might wrongly terminate or take other improper actions against LGBT workers. In one instance an employer passed over a transgender woman for a laboratory technician job and also fired her from her contractual job when she used her preferred gender and name on an application. Other examples include the denial of benefits or the loss of a job because of sexual preferences or gender expression.  2. Sexual assault In the worst cases, LGBT people are the victims of sexual assault, battery or rape. Gay, lesbian, bisexual and transgender people may suffer abuse or receive threats at work."
The new paradigm maintains that criminal behavior must be punished no matter what gender, race, sex or religion the victim is, therefore a transgender victim should receive equal justice under the law.
