Justice Heather Perkins-McVey of the Ontario Court of Justice will decide the forfeiture of Chris Barber's truck and livelihood Big Red on December 19th.

She will specifically rule on the defence's application for a summary dismissal, and if the defence is unsuccessful, the rest of the forfeiture application will continue in 2026.

The crown got their submission to the defence on Saturday. Brendan Miller for the defence responded to that last night. Then today the crown asked for more time to review Miller's material. Miller said he sent the crown his original material some time ago.

For clarity, these proceedings are the crown trying to seize Chris Barber's truck. Tamara Lich is not directly involved.

Miller argued that the law is clear: When forfeiture involves innocent third parties, there's a different set of parameters. The bar is lower.

During all of the activities involving Big Red at the Convoy, the truck was owned by CB Trucking. The truck is now owned by another company that is associated with Chris Barber's father. The new company is innocent in the matter.

Miller also discussed costs to the innocent third parties for these proceedings if the forfeiture is dismissed. That issue would be dealt with afterwords should the defence win on the 19th.

This whole process is venomous and vindictive. It's the big boot of the government crushing people they don't like. Our country is on a dark path.
