"WE THE PEOPLE of the United States, in order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."
On the 13th of this month, six days ago, the United States Supreme Court heard arguments in a case brought before them which will determine if our Constitution will be allowed to "secure the Blessings of Liberty to ourselves and our Posterity." The case is titled, "National Labor Relations Board vs. Noel Canning," and the Court will decide if the United States Constitution governs America or not.
There are certain presidential appointments to Governmental positions which, Constitutionally, must be voted on by the Senate in order for them to be approved or rejected. The president has the authority to appoint people to those positions without Senate approval only if, and when, the Senate is in official recess. The Court is being asked to decide if the United States Senate is the determining authority to declare when it is or is not in recess.
Why has it been asked to decide this? In 2012 President Obama appointed three individuals to the National Labor Relations Board. These are some of those governmental positions which must be voted on by the Senate. He claimed the Senate was in recess and not in session, which gave him the right to make those "recess appointments." The fact is, that even though most Senators were out of town and not in the Senate Chamber, they had not declared a recess. President Obama took it upon himself to declare them in recess.
Webster's College Dictionary: Tyranny; the office, authority, government, or jurisdiction of a tyrant, or absolute ruler. If you have been listening to the news reports, you have seen Obama making the statement in public on January 14, five days ago, and I quote, "that we are not just going to be waiting for legislation in order to make sure that we're providing Americans the kind of help they need. I've got a pen and I've got a phone, and I can use that pen to sign executive orders and take executive actions...." He is promising us, with those statements, to continue to ignore the congress we elected and act as an absolute ruler.
I agree with Kathleen Dynan when she writes about the National Anthem and Francis Scott Key saying "the land of the free and home of the brave." She writes, "Whatever the Supreme Court decides in this case, our freedom is threatened by this behavior. To stay free, Americans must be brave. We must use another American right to save us from tyranny, the right to vote. Use the 2014 elections to rid congress of those who support Obama. Vote them out."
