Imagine, if you will, that the United States Congress were to take the necessary action to correct the bizarre wild-eyed rogue Democrat queered Federal Courts that are exceeding their authority all over America. The best corrective action would be to dissolve and totally defund the current lower court system. That is far easier than trying to cut and paste the existing system. Congress has a poor record of trying to fix existing problems.
The next step would be to create a new comprehensive lower court system with:
1. Defined term of service for the appointed justices, thereby eliminate lifetime appointments with no accountability.
2. Defined authority limiting opinions to the justices’ geographic district.
3. If a justice has 50% or more decisions overturned by a higher court that would be grounds for removal mid-term.
4. Limit the lower court authority so that only the Supreme Court of the United States (SCOTUS) can render opinions concerning the Executive Branch of government. These lower courts can hear actions against the Executive Branch but cannot hinder Executive Branch operations. If an action has merit, it must proceed through the process to the SCOTUS for final disposition.
Imagine that Congress does their duty and a new federal lower court system is created in parallel with the dissolution of the old system. How do you think the deranged socialist Democrats will feel about President Donald J. Trump appointing all of the hundreds and hundreds of new federal judges? You know, justices who understand and respect the United States Constitution. What a concept!
The Democrat bosses and their bosses have once again not thought things through very well. The socialist Democrats thought they could bastardize the legal system for their own purposes, but they only exposed a critical existential flaw in that system, which, if allowed to continue, could destroy the nation. Once again, these enemies of America were not careful what they wished for.
There is one other potential solution to the immediate problem. SCOTUS could render an opinion that the United States Constitution does not provide authority for these lower courts to, in any way, hinder the operations of the Executive Branch of the United States. This action would limit activities of these rouge judges.
Whether or not SCOTUS steps up, Congress does need to take the time to correct the flaws that have been exposed in the current lower court system. Continuing with these district court judges effectively interfering with the Executive Branch’s management decisions gives these lower court judges a power that was never named or intended by our Founding Fathers.
Imagine, if you will, Trump appointing all the judges for the new system and how entertaining it would be to watch the Left go nuttier than they already are. What fun!
