Crown drops Covid charges against Derek Sloan, Randy Hillier, and other protestorsNORFOLK, ONTARIO: The Justice Centre for Constitutional Freedoms is pleased to announce that the Crown has dropped charges against former MPP Randy Hiller, former MP Derek Sloan, Pastor Heinrich Hildebrandt, and private citizen, Dan Stasko. The four men were allegedly involved in peaceful rallies against Covid measures in June 2021 and were charged with violating public health orders under the Reopening Ontario Act. After negotiations with Bally Hundal, a lawyer retained by the Justice Centre, the Crown dropped all charges, stating that prosecution was no longer in the public interest.

Ontario Judge releases Tamara LichOTTAWA: The Justice Centre for Constitutional Freedoms is pleased with the decision of Ontario Superior Court Justice Andrew Goodman releasing Tamara Lich from jail. Justice Goodman, after a two-day hearing, overruled the prior decision of a Justice of the Peace, who re-incarcerated Ms. Lich for alleged breach of bail conditions. Ms. Lich spent 49 days in jail, despite having no criminal history or record, on mischief-related charges that do not involve violence. Justice Goodman released Ms. Lich on the existing amount of $37,000 in bond without deposit. The Judge noted, “Counsel is well aware that accused persons facing more serious indictable offences and with breaches of release terms are granted bail.”

In a Decision released on May 13, 2022, in Ontario's Superior Court of Justice, Justice John Fregeau ruled that members of Parliament and the Senate enjoy the absolute right to freedom of expression in parliamentary debate, and struck down as unconstitutional parts of federal legislation that had prevented certain members from disclosing information on national security matters.

Tamara Lich appeals bail conditions that violate her Charter freedoms

OTTAWA: The Justice Centre for Constitutional Freedoms today announced that one of the participants of the Ottawa truckers freedom convoy, Tamara Lich, will appeal the bail conditions imposed on her by the Ontario Superior Court. On March 7, 2022, Justice John M. Johnston released Tamara Lich from jail, in accordance with her Charter right to be presumed innocent unless and until proven guilty. While the bail conditions align with Ms. Lich's Charter right to be presumed innocent, they also violated Tamara Lich's Charter freedoms of expression, association and peaceful assembly through the following bail conditions:

For the purposes of this Act, a national emergency is an urgent and critical situation of a temporary nature that
  1. seriously endangers the lives, health or safety of Canadians and is of such proportions or nature as to exceed the capacity or authority of a province to deal with it, or
  2. seriously threatens the ability of the Government of Canada to preserve the sovereignty, security and territorial integrity of Canada
and that cannot be effectively dealt with under any other law of Canada.

"It is winter in Canada. Protesting publicly in freezing temperatures requires the truckers to have fuel to stay warm. Confiscation of fuel jeopardizes the personal safety of the peaceful protesters," states lawyer Jay Cameron, Litigation Director at the Justice Centre.

Justice Centre sues Ontario Government over vaccine passportTORONTO, ON: The Justice Centre has filed a constitutional challenge against Ontario’s vaccine passport mandate in Ontario’s Superior Court of Justice. The legal challenge is brought on behalf of eight Ontario citizens who are exercising their Charter rights and freedoms by not taking one or more doses of the Covid vaccine. One of the eight applicants in this court case is Sarah Lamb, from Kitchener. She suffered serious adverse effects from the first dose of the Covid vaccine and has decided against a second dose. Ms. Lamb has been unable to obtain an exemption to the vaccine passport. The Ontario government has proclaimed that exemptions to the vaccine passport would only be accepted in very limited cases.

Justice Centre gives Ontario final warning over vax passports

TORONTO: The Justice Centre for Constitutional Freedoms has issued a legal warning letter to the Ontario Government on behalf of four clients demanding the vaccine passport mandate be revoked immediately. The law requires Ontarians as young as 12 to provide proof of two doses of the Covid mRNA vaccination as of September 22, 2021, or be denied access to a wide range of businesses and organizations, including field trips to city facilities. The Justice Centre has notified the Province that it will file a legal action should Ontario fail to halt its unconstitutional discrimination against those who have not yet chosen to receive the experimental vaccines.

Covid tickets continue to be dropped by CrownALBERTA/SASKATCHEWAN: The Justice Centre for Constitutional Freedoms is pleased to announce that four more Public Health Act tickets issued to individuals in Alberta and Saskatchewan for the exercise of their Charter rights have been dropped by Crown prosecutors. The Justice Centre represents hundreds of individuals all across Canada who have, among other things, been ticketed for allegedly breaching public health orders by participating in peaceful protests, uncovering their faces when doing so is outlawed, attending church, providing services during lockdowns, receiving friends and family into their homes, exercising their right to enter and leave the country, and refusing to post government propaganda Covid signage.

Aylmer Church of God found in contempt of court and sentenced for third time for holding outdoor worship servicesST. THOMAS: The Justice Centre for Constitutional Freedoms was in virtual court today in St. Thomas, Ontario, on behalf of the Church of God (Restoration) Aylmer, as the Attorney General of Ontario demanded over $200,000 in contempt sanctions, plus court costs, stemming from three outdoor services held by the Church of God. The Court refused to award the figure sought by the government, and instead fined the Church and its leaders a total of $85,500, plus court costs of $5,000. The targeted enforcement order obtained by the government on February 12, which the Church has been repeatedly accused of violating, is being challenged by the Justice Centre on constitutional grounds. The matter is set for a three-day hearing beginning on October 4, 2021.
