Nebraska Senator Should Reject Obama Supreme Court Choice

(Omaha, NE) The nation’s leading grassroots military-support organization, Move America Forward, is calling on Nebraska U.S. Senator Ben Nelson to join with Senator Mike Johanns and oppose the nomination of Elena Kagan to the United States Supreme Court.

Military families and their supporters are extremely displeased President Barack Obama has chosen Solicitor General Elena Kagan to join the U.S. Supreme Court, and they are urging the United States Senate to defeat her nomination. Appearing at an Omaha news conference to express the organization’s opposition, former Navy S.E.A.L., Benjamin Smith, said, “It is an outrage to every military man and woman that a person such as Elena Kagan would withhold support for our military at a time of war against Islamic terrorism to benefit her own liberal political views. She clearly lacks good judgment and should not be confirmed to the Supreme Court.” Smith went on to say that “the Supreme Court will undoubtedly be handling important cases dealing with the terrorist threat to America. We cannot afford to have on the Supreme Court a Justice like Kagan who does not treat the war on terrorism as a serious matter. Her conduct at Harvard against the military is reprehensible at any time, especially at a time of war. Her attempts to explain away her actions have only increased our skepticism of suitability for the Court. This person lacks good sense and judgment.” “During a time of war, when America faces threats from Islamic terrorists, and when we have troops fighting on the ground in Afghanistan and Iraq, we need a judge who understands and supports our military. Elana Kagan is not that person!” said Danny Gonzalez, Director of Communications for Move America Forward. When Kagan was Dean of Law at Harvard University, she expelled military recruiters from campus in defiance of The Solomon Act, which she has argued against in writing and speeches. She, along with 40 other law professors, argued to the Supreme Court against the Soloman Act, but her arguments were rejected by even the most liberal justices.
