ASHLAND, KY - On Monday, Federal District Judge David Bunning denied ACLU's motion to reopen its request to certify a class action against Rowan County, Kentucky Clerk Kim Davis.
"The ACLU's attempt to quickly expand this case into a class action has been derailed. The case is moot and should be dismissed. The ACLU knows the problem it faces and has tried to avoid the fact that its case is moot," said Mat Staver, Founder and Chairman of Liberty Counsel.
Soon Liberty Counsel will file its brief on the merits of the case with the Sixth Circuit Court of Appeals. Thus far the Court of Appeals has ruled only on various requests to stay the proceedings, but has not yet ruled on the merits of the case. Following briefing and oral argument, the Sixth Circuit will issues its opinion, but that ruling is not expected until sometime in 2016.
