It is not the time for acceptance of their evil laws, but to pledge no compliance

It must be clear by now that ObamaCare is the law. How many times have you heard that phrase in the past two weeks from Obama fans like Kirsten Powers from Fox News, George Stephanopoulos from ABC and CNN anchor Brooke Baldwin (Baldwin said, “Congress passes a law, in this case ObamaCare, and then some of its members turn around and essentially try to sabotage it. Again, I repeat, it’s a law). Even Judge Judy said "it's the law" to Megyn Kelly on last Friday's The Kelly File.
The same liberals who today shout in unison "ObamaCare is the law" ignore the Ten Commandments and the Constitution. What did they learn while in school? Did they miss out on Civics lessons? Is it a disease contracted by the inbreeding of the DC elitists? First, let us recall how ObamaCare became the law. No one knows who wrote the 2,471 pages bill but it was done exclusively by Democrats; and not one member of Congress read it. Candidate Barack Obama campaigned for the need to reform our health care system because it was "a threat to our economy" and that it should be a right for every American.

The House, with a Democrat majority, voted 220-215 to approve the Affordable Health Care for America Act (HR 3962). Only one Republican voted for the bill, and 39 Democrats voted against it. The Senate then approved a similar health care reform legislation (HR 3590), in a 60-39 party-line vote after a procedural move co-opted (how is this legal?) HR 3590, the Service Members Home Ownership Tax Act of 2009, a bill that had passed the House on Oct. 8 to modify homebuyers credit for members of the Armed Forces and certain Federal employees, and turned it into the Patient Protection and Affordable Care Act. No Republican Senator voted for the bill. But even among Democratic Senators the bill was not passed without first "buying the votes" of some Senators such as Ben Nelson's with the Cornhusker kickback ($100 million for Nebraska) and $300 million Medicaid aid for Senator Landrieu's Louisiana. Negotiations to reconcile the House and Senate bills stalled in Congress After Scott Brown (R-MA) won late Ted Kennedy's (D-MA) vacant Senate seat in Jan. 2010, Senate Democrats lost their 60 filibuster proof number. On Mar. 21, 2010 the House approved the Senate's bill (HR 3590) in a 219-212 vote and passed the House's amendments to HR 3590 as the Health Care and Education Reconciliation Act of 2010 (HR 4872) in a 220-211 vote. In the House, Congressman Bart Stupak of Michigan, who had opposed the bill because of abortion funding, changed his vote after President Obama pledged that this health care bill would not allow expansion of abortion services, but later the administration reneged on its word. No Republican in the House voted for either HR 3590 or the reconciliation bill. President Obama signed the Patient Protection and Affordable Care Act (HR 3590) into law on Mar. 23, 2010. The history of how Obamacare became law is one of deception, bribery, and lying. After the law was passed, several individuals and 26 states sued to strike it down as unconstitutional based on the Commerce Clause. But on June 28, 2012, the Supreme Court upheld the individual mandate by a vote of 5 to 4 with Chief Justice John Roberts siding with the majority. Justice Roberts actually changed the law in order to approve of its constitutionality by making "the penalty" for not buying insurance "a tax." Second, let us recall the promises by President Obama on how PPACA would benefit Americans.

How are these promises working out now? Since it is not happening as the President promised us, why then should we not try to either defund or delay this law? Congress has the constitutional authority to legislate, that means not only making new laws, but changing/modifying, delaying or repealing bad laws. The House has the constitutional right and responsibility of funding, not the Senate, and surely not the President. The last and perhaps most glaring example of not complying with the law is the President's non-compliance as he sees fit. President Obama has unilaterally called for a delay in employer mandate and exemptions to his friends in business and to the federal employees including all three branches of the federal government. His blatant disregard for the law is clearly unconstitutional. But this is not the only time Obama has decided to pick and choose which laws he executes. For those who clamor loudly "It's the law," let us remind them that immigration enforcement, Defense of Marriage Act are laws that have been violated by the president, while the current EPA regulations have not been legislated (Cap & Trade was defeated in Congress). When a lawless president who consistently violates the Constitution, and a Senate that does not even offer a budget continue to exercise their will over the American citizens without their consent, it is not the time for acceptance of their evil laws, but to pledge no compliance.

Elvira Fernandez Hasty -- Bio and Archives

Elvira Fernandez Hasty was born in La Habana, Cuba, to immigrants from Spain.  She attended a private Catholic school for women, French Dominicans School, until the age of fifteen.  At that time, the Castro regime militia invaded her home one night in order to question her 20 year old sister, Rose, about her involvement in “counter-revolution” at the University.  After some months of anguish, my father arranged for Rose to obtain diplomatic protection from the country of Honduras, and the decision was also made to send me away before confiscation of private schools by the communist government.  My sister flew to Honduras under the protection of the Ambassador on January 24, 1961, while I left the country for Florida the next day via the Pedro Pan organization that was formed to protect Cuban children from Marxist indoctrination. 

After finishing high school in Florida and working at an electric company billing department, Elvira continued her studies at St. Mary College in Kansas.  She graduated cum laude with a BS in Chemistry and later received her PhD in Chemistry from the University of Illinois at Urbana, IL.  Dr. Hasty spent twenty years in college teaching and research, becoming Associate Professor of Chemistry and Chairperson at Mundelein College in Chicago. 

In 1997, Elvira and her husband James, moved to Ponte Vedra Beach, Florida, where she currently resides.  She has been politically active since then, first in the Republican Party and lately in her own conservative organization, Ponte Vedra Conservative Women, a group of conservative women concerned about the future of our country. We are united by our common desire to preserve our Constitution, the principles of our Founding Fathers, and our Judeo/Christian values.
