ICYMI: Watch FBI Director James Comey abandon the rule of law



If you read Dan's piece on FBI Director James Comey's announcement, you know what I think. The decision not to indict Hillary Clinton is the moment at which the United States crossed the line which separates a "dysfunctional mess" from a genuine "third-world-style banana republic." We no longer adhere to the rule of law or, if we do, we apply it differently to different classes. The political class operates with one playbook, while the rest of us are tied to another, much harsher, set of rules. I mean, for God's sake, the first ten minutes of Comey's address sounded like he was leading up to an indictment. He outlined, with excruciating specificity, her many prosecutable actions. Then, he did a 180 and went the other way. As Andrew McCarthy of the National Review wrote:

Clinton: Part of America's protected class... all but untouchable

There is no way of getting around this: According to Director James Comey (disclosure: a former colleague and longtime friend of mine), Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18): With lawful access to highly classified information she acted with gross negligence in removing and causing it to be removed it from its proper place of custody, and she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust. Director Comey even conceded that former Secretary Clinton was “extremely careless” and strongly suggested that her recklessness very likely led to communications (her own and those she corresponded with) being intercepted by foreign intelligence services.
But hey, this is a Clinton. As part of America's protected class, she is all but untouchable. Her crimes are irrelevant and, if you count yourself among the plebeians who demand her prosecution, you've simply forgotten your place. You have no business demanding your betters be subject to the same rules that - had you done what Hillary did - would have landed you in prison months ago.
